About The Position

Farm Family is seeking a highly capable Senior Technical Litigation Claims Specialist to join their team. This is a full-time, exempt position that requires working 100% in-office, five days a week, to foster culture, team connections, and profitability. The role reports to the VP of P&C Claims Litigation and is responsible for negotiating lawsuits and directing the activities of defense attorneys. This includes overseeing litigation strategy and actions for claims involving litigation and/or complex injuries, requiring advanced technical proficiency in investigation, coverage and exposure evaluation, negotiation, and resolution. The Senior Technical Litigation Claims Specialists contribute to providing superb results for clients.

Requirements

  • Advanced knowledge of managing litigated claims.
  • Exceptional customer service focus.
  • Juris Doctor from an accredited law school.
  • A minimum of 5 years’ managing litigated claims, including body injury experience in determining liability, negotiating settlements, reviewing estimates, and medical terminology.
  • Must be able to obtain necessary state licenses and maintain Continuing Education (CE) requirements.
  • Good business acumen (understanding how an insurance company works and makes money, and how the role impacts profitability).

Responsibilities

  • Adjudicate highly complex litigated claims under limited technical direction and within broad limits and authority, potentially with significant impact on departmental results.
  • Provide laser-focused customer service by delivering superior claims outcomes and developing meaningful connections with insureds and brokers.
  • Conduct in-depth reviews of coverage to determine the sufficiency of information for correct decision-making.
  • Complete in-depth reviews of investigations to evaluate sufficiency and ensure correct exposure assessment, verifying that the investigation supports the exposure analysis.
  • Coordinate litigation plans with defense counsel, ensuring cost-effectiveness and alignment with the insured's best interests.
  • Handle high severity multi-line litigation claims across all lines of business, including property, liability, first and third-party exposure cases, Errors and Omissions claims, Direct Action lawsuits, Commercial Agriculture and Construction Litigation, and Actions against the company for Extra Contractual Exposures.
  • Receive and handle claims from inception or transfer, review notices of loss to determine proper coverage, and establish/maintain proper reserves.
  • Conduct prompt and thorough investigations, including interviewing involved parties, to properly evaluate and assess exposure.
  • Review relevant venue-specific case law.
  • Complete case evaluations and ensure proper reserves are placed according to the company's reserving philosophy.
  • Make daily decisions on the appropriate course of action for files, considering insured, company, and cost factors.
  • Attend depositions, court-ordered mediations, trials, arbitrations, and settlement meetings as required, which may involve overnight travel.
  • Negotiate in a timely and effective manner to provide cost-effective solutions within established limits, utilizing various negotiation styles.
  • Consider Alternative Dispute Resolutions and utilize creative resolutions when appropriate.
  • Manage diaries and complete tasks to ensure cases achieve the best financial outcome and timely resolution.
  • Review legal expenses incurred in the defense of litigation.
  • Report to the Claims Committee as appropriate.
  • Evaluate claims for bodily injury, review medical reports/records/bills, and calculate past/future medical expenses and wage loss.
  • Analyze the value of Personal Injury Claims for compensation, considering past and future values.
  • Confirm and/or perform permanency ratings according to AMA guidelines to assess exposure and claim value.
  • Recognize, investigate, and handle recoveries from subrogation, salvage, liens, loss transfers, or other related claim areas.
  • Handle all correspondence relating to litigation files and respond accordingly.
  • Communicate and maintain professional relationships with insureds, claimants, agents, attorneys, vendors, and management regarding claim status.
  • Mentor lower-level litigation and claims employees.
  • Present various items to management.
  • Assist in training throughout the company as needed.
