About The Position

The Confidential Client seeks a full-time Staff Attorney for its Immigration Litigation Department. The attorney will manage a caseload spanning removal defense, federal litigation, and administrative agency matters, including proceedings before U.S. Citizenship and Immigration Services (USCIS), the Executive Office for Immigration Review (EOIR), the Board of Immigration Appeals (BIA), and federal courts nationwide. The role requires an attorney licensed in at least one state, with three to five years of removal-defense experience and at least one year of federal-court litigation experience. The successful candidate will bring sound judgment, demonstrated case-management ability, comfort working with a diverse client base and workplace, and a willingness to address novel legal issues, often involving national-security concerns.

Requirements

  • Admission to the bar of any U.S. state and admission in at least one federal jurisdiction.
  • Three to five years of removal-defense experience and at least one year of federal-court litigation experience.
  • Advanced legal research and concise legal writing skills, particularly in removal defense and federal litigation.
  • Critical thinking and complex legal problem-solving ability.
  • Clear communication, collaboration, and demonstrated leadership ability.
  • Proven ability to work independently and effectively under pressure.
  • Initiative, strong attention to detail, reliable work ethic, and ability to manage multiple priorities.
  • Aptitude for training department personnel and assuming progressively greater leadership in client matters.
  • Cultural sensitivity and ability to work effectively with diverse groups.
  • Commitment to annual substantive training on litigation and immigration-law developments.

Nice To Haves

  • Knowledge of national-security and free-speech issues as they relate to immigration law.
  • Proficiency in one or more languages in addition to English.

Responsibilities

  • Contribute to case selection and development through legal screenings, client consultations, factual and legal research, evaluation of legal theories and strategies, and assessment of removal defenses and federal-court litigation, including habeas relief.
  • Develop removal-defense strategies and manage a diverse, nationwide caseload, with a prominent role in federal habeas petitions and temporary restraining orders for detained clients.
  • Research BIA and relevant district- and circuit-court case law, statutes, regulations, and policies applicable to removal-defense strategies.
  • Litigate defensive asylum, withholding of removal, and Convention Against Torture claims before EOIR, the BIA, and circuit courts, including drafting federal complaints, briefs, motions, appeals, habeas petitions, and petitions for review.
  • Prepare clients and witnesses, compile research and supporting evidence, and coordinate expert witnesses for individual merits hearings.
  • Ensure proper administrative exhaustion, with close attention to applicable procedures.
  • Independently track deadlines established by administrative agencies, courts, and internal protocols.
  • Collaborate with internal and community partners on articles, legal presentations, informational videos, and immigration-law public education.
  • Travel as required.
