About The Position

Harris Beach Murtha seeks a mid-level litigation and compliance attorney to counsel and represent health care facilities, practitioners, and other entities and individuals in the health care industry with respect to regulatory compliance, litigation, audits, investigations, clinical operations, and business operations matters. The ideal candidate will have experience navigating the business and regulatory aspects of health care law, including Stark, Anti-Kickback, HIPAA, fraud and abuse, compliance, medical staff matters, and reimbursement issues, while working collaboratively with colleagues across practice areas to deliver exceptional client service.

Requirements

  • 3-5+ years’ experience in health care and regulatory litigation
  • Juris Doctorate from an ABA-accredited law school
  • Admission to NYS bar (or ability to waive in)
  • Excellent research, writing, and verbal communication skills
  • Strong organizational skills and the ability to prioritize workload effectively
  • Demonstrated ability to rapidly absorb and analyze new information
  • Ability to manage competing priorities in a fast-paced environment
  • A high level of professionalism, conscientiousness, and responsibility
  • A positive, flexible, and cooperative attitude
  • Ability to work effectively with diverse personalities across all levels of the organization

Responsibilities

  • Represent clients in courtroom proceedings, mediations, arbitrations, and administrative proceedings
  • Take and defend depositions
  • Research legal issues and collaborate with senior attorneys on litigation strategy
  • Draft memoranda, pleadings, motions, briefs, and discovery documents
  • Manage discovery, including medical records, billing, and health plan documentation
  • Work on government (Medicare and Medicaid) and commercial payer audits and investigations
  • Work across a variety of health care litigation and regulatory matters
  • Create compliance programs for health care providers, suppliers, and managed care plans
  • Draft and revise compliance policies and procedures
  • Analyze records and transactions related to business disputes and investigations as to potential client claims
  • Structure, negotiate, and draft contracts and other business arrangements
  • Advise clients on a wide range of compliance and health regulatory matters
