This Law Clerk II role reports to the Legal Office Supervisor/Senior Manager of Legal Support. The primary responsibility is to assist Lawyers in handling Property & Casualty (P&C) Insurance Legal Matters. This involves representing TD Insurance or its policyholders in civil litigation and no-fault/accident benefits matters, specifically those involving claims for monetary damages or compensation for personal injury or property damage.

Requirements

  • Paralegal/Law Clerk diploma/certificate from a recognized educational institution or equivalent work experience at a reputable law firm or legal department.
  • 1-5 years paralegal/law clerk experience or equivalent.
  • Knowledge of legal and court documents and procedures.
  • Knowledge of standard office equipment and word processing.
  • Excellent oral and written communication.
  • Ability to communicate effectively with insured clients, claims representative and court/tribunal staff.
  • Excellent legal drafting skills and eye for detail.
  • Motivated self-starter with ability to work productively under pressure and deliver business results.
  • Strong interpersonal & client service skills; professional and positive demeanor.
  • Superior organization & priority setting skills, strong work ethic and ability to mutli-task.
  • Conceptual and creative problem-solving skills.

Nice To Haves

  • Background in insurance defense litigation, including personal injury and accident benefit claims, and/or general litigation experience.

Responsibilities

  • Reviews and analyzes new file assignments, organizes file contents, and prepares summary memoranda of medical, investigation and all documentary productions received.
  • Updates/posts in electronic systems all relevant work completed on a file.
  • Prepares affidavit of documents for review by Lawyer and arranges and manages undertakings chart.
  • Organizes and prepares files for discovery/questioning.
  • Follows up on undertakings and production requests.
  • Prepares document briefs for expert reviews and drafts motions.
  • Other duties as instructed by the Lawyers, which may vary by jurisdiction.
  • Remains current with developments in the law; understands medical, scientific, construction, product liability, engineering issues and defenses involved with such cases.
