About The Position

This is independent and complex administrative and consultative work providing coordination of the administrative activities of the Public Records Section. This position is in the Public Records Section and deals with legal issues related to the Department’s obligations under Chapter 119, Florida Statutes (the Public Records Law), criminal discovery requests, subpoenas and other demands for records production, Department requests, and Capital Post Conviction requirements.

Requirements

  • Knowledge of the procedures and techniques for effective verbal and written communication;
  • Knowledge of Florida Statutes and Attorney General’s opinions as related to public records and dissemination of records to various entities;
  • Ability to read and understand criminal investigative and intelligence data;
  • Ability to collect, evaluate, analyze and summarize criminal investigative and intelligence data;
  • Ability to review large amounts of criminal investigative and intelligence data and determine the significance, completeness and usefulness of the data;
  • Ability to plan, organize, coordinate and complete work assignments;
  • Ability to establish and maintain effective working relationships with others;
  • Ability to work independently.

  • Preference will be given to current FDLE members who have satisfactorily completed at least six months of the probationary period for their current position.

Responsibilities

  • Researching, retrieving, and coordinating with field liaisons for the retrieval of records from the various record systems of the department;
  • Analyzing records for completeness and accuracy for each request;
  • Reviewing all records for all applicable exemptions under current Florida and/or federal law, redacting exempt and confidential information before the records are released to the requestor, and confirming exemptions claimed with Department’s legal staff as needed;
  • Ensuring record production in Capital Post Conviction cases pursuant to the Rules of Criminal Procedure to ensure that records produced are filed with the records repository of the Department of State within the time requirements of the rule;
  • Arranging for the prompt delivery of all nonexempt records to the requestor, with written reference to the statutory basis for all claimed exemptions from disclosure;
  • Arranging for delivery of unredacted records to criminal justice agencies;
  • Ensuring that all requests are properly docketed and closed upon completion, and ensuring completeness of FDLE responses to records requests by reviewing documents provided, pursuant to records searches conducted, to ascertain that responses address the specific nature of the requests;
  • Keeping account of all costs associated with responses to records requests, including personnel time, number of pages or digital file copies, programming costs, and other duplication costs.
