About The Position

The Bankruptcy Specialist is responsible for the day-to-day administration and processing of mortgage servicing bankruptcy cases. This position manages a portfolio of Chapter 7, Chapter 11, Chapter 12, and Chapter 13 accounts, ensuring compliance with bankruptcy court requirements, investor guidelines, and mortgage servicing regulations. The Bankruptcy Specialist performs case review, proof of claim preparation and filing, bankruptcy payment monitoring, plan review, discharge processing, and communication with attorneys, trustees, borrowers, and internal business partners. This role is hands-on and focused on ensuring all bankruptcy activities are completed accurately, timely, and in compliance with applicable regulations and investor requirements.

Requirements

  • High School Diploma or GED required.
  • 2-5 years of mortgage servicing bankruptcy experience preferred.
  • Experience administering Chapter 7 and Chapter 13 bankruptcies.
  • Experience preparing and filing Proofs of Claim.
  • Knowledge of bankruptcy payment processing and plan monitoring.
  • Familiarity with bankruptcy court documents and procedures.
  • Experience working within mortgage servicing platforms.

Responsibilities

  • Administer and process Chapter 7, Chapter 11, Chapter 12, and Chapter 13 bankruptcy cases.
  • Process bankruptcy payments and monitor post-petition payments.
  • Prepare and file Proofs of Claim.
  • Review and analyze Chapter 13 plans.
  • Process discharges.
  • Review reaffirmation agreements.
  • Review motions and pleadings.
  • Provide bankruptcy litigation support.
  • Review and board new bankruptcy filings.
  • Maintain accurate bankruptcy records within servicing systems.
  • Monitor trustee payments and apply bankruptcy-related transactions correctly.
  • Track critical bankruptcy deadlines and ensure timely completion of required actions.
  • Review bankruptcy notices, motions, objections, and other court documents.
  • Coordinate with internal departments regarding loan status changes resulting from bankruptcy proceedings.
  • Process loan treatment following dismissals, discharges, conversions, and case closings.
  • Maintain documentation supporting bankruptcy activity and servicing decisions.
  • Respond to bankruptcy-related inquiries from borrowers, trustees, attorneys, and internal stakeholders.
  • Monitor Chapter 13 trustee payments and repayment plan performance.
  • Review post-petition payment activity and identify delinquencies.
  • Process repayment plan changes and modifications.
  • Track cure payments and account reconciliations.
  • Ensure bankruptcy transactions are accurately reflected within servicing systems.
  • Identify and escalate servicing issues that may impact bankruptcy compliance.
  • Ensure activities comply with U.S. Bankruptcy Code, Federal Rules of Bankruptcy Procedure, CFPB Mortgage Servicing Rules, RESPA (Regulation X), FDCPA, Fair Credit Reporting Act (FCRA), Servicemembers Civil Relief Act (SCRA), FHA, VA, USDA servicing requirements, Fannie Mae Servicing Guide, Freddie Mac Seller/Servicer Guide, Ginnie Mae requirements, and applicable state and federal laws.
  • Maintain compliance with court timelines and filing requirements.
  • Escalate potential compliance concerns to management.
  • Assist with audit and examination requests by gathering documentation and responding to inquiries.
  • Participate in implementation of regulatory or investor guideline changes.
  • Coordinate foreclosure holds and stay-related activities.
  • Support loss mitigation efforts involving active bankruptcies.
  • Assist with servicing transfers involving bankruptcy accounts.
  • Provide case status updates and supporting documentation as needed.
