About The Position

The Senior Managing Litigation Attorney will oversee a team of attorneys, from entry-level to senior litigation management attorneys, managing the entire employee lifecycle including identifying, training, coaching, and retaining talent. This role is responsible for overseeing and reviewing the work of attorneys to ensure compliance with defense counsel guidelines, improving processes, and assisting with budget planning, financial measures, and results. The Senior Managing Attorney will identify and lead initiatives to enhance team efficiency and ensure effective communication between legal and business teams. This position functions as both a Litigation Attorney with a reduced case count and a manager for a staff of Litigation attorneys, operating autonomously under the general supervision of the Litigation Management’s department Director.

Requirements

  • Bachelor’s degree from four-year college or university required.
  • Juris Doctorate from an accredited law school required.
  • Minimum 15 years of workers’ compensation legal experience handling complex cases required.
  • Minimum 2 years of managing experience of associate attorneys through senior litigation attorneys highly required.
  • Licensed and in good standing with the State Bar of California with no history of public or private reprisals.
  • Expert knowledge litigating California workers’ compensation matters with trial experience and prior experience handling cases with varying degrees of complexity.
  • Deep understanding of workers’ compensation administrative rules, laws, statutes, legal principles and practices.
  • Ability to work with Excel including skilled at creating financial and performance reports.
  • Ability to communicate effectively with external and internal team members, clients, businesses, and members of the State Bar and Judiciary, including effectively responding to concerns and sensitive matters.
  • Proficient use of applications and programs to create automated reports, templates, systems and data retrieval of high quality and reliability.
  • Excellent oral and written communication skills.
  • Skilled at logical thinking to define problems, collect data, establish facts, and draw valid conclusions.
  • Consistently maintains professional and appropriate demeanor, works harmoniously with others and responds positively to feedback.
  • Ability to effectively present information, verbally and in writing, to clients, claims personnel, top management, public groups, Board of Directors, mediators, arbitrators, judges, and juries.
  • Demonstrated experience in working independently under minimal supervision, maintaining a strong work ethic, and exercising initiative.

Responsibilities

  • Directs the operations of law office personnel providing litigation and legal services.
  • Oversees the law office activities to ensure efficient operations of In-House Counsel.
  • Determines the intake and assignment of cases to ensure distribution based on each attorney’s level of expertise and associated location (region or county).
  • Achieves the departments and company goals by making strategic business decisions.
  • Ensures the firm is achieving its client satisfaction goals by evaluating productivity and quality of service.
  • Identifies, makes recommendations for work process improvements and follows through to implement remediations.
  • Works with leadership to ensure the department meets financial and ROI goals, identifies trends, prepares reports, and implements modifications as needed.
  • Mentors less experienced attorneys and ensures the team continues to expand their job-related knowledge, skills and abilities.
  • Regularly reviews cases and provides feedback on legal strategies, compliance with deadlines, timeliness on response, and maximizing the department’s core goals.
  • Provides litigation services and is responsible for all aspects of assigned Workers’ Compensation matters.
  • Handles a reduced caseload of litigated files and ensures files are fully worked and moved to resolution.
  • Litigates workers’ compensation cases in California before all state and federal courts, administrative boards, and other court proceedings.
  • Represents ICW Group, its related entities and insureds before administrative boards, state and federal courts, Court of Appeal, and the California Supreme Court.
  • Analyzes complex legal and factual issues; conducts extensive, well-reasoned legal research, as necessary; independently develops and presents defense strategies on behalf of ICW Group.
  • Provides strategic legal advice, recommendation, and implementation of clear, cost-effective, and efficient plans of action.
  • Assists in analyzing, reviewing, and distributing information on new legislation, regulations, and court decisions.
  • Provides oversight of a team of Litigation Management professionals.
  • Supervises and evaluates, mentors, motivates, and develops attorneys to strengthen the legal team.
  • Communicates clear performance expectations for the assigned team as well as providing support and guidance for achieving the departments metric, billable hours and expectations.
  • Communicates and enforces team values including mission statement of In-House Counsel (IHC) and ICW.
  • Establishes and maintains the overall work cadence and, in partnership with Department leadership; ensures performance and outcomes strive for excellence in delivery and customer experience.
  • Acts as a resource for team members to answer questions and assist in the solution to complex problems.
  • Directly supervises employees within the Litigation Management team and carries out supervisory responsibilities in accordance with company policies and applicable laws. These responsibilities include interviewing, hiring, and training employees; planning, assigning, and directing work; conducting performance and salary reviews; rewarding and disciplining employees; addressing complaints and resolving problems; coaching, mentoring, and developing team members to further their skills and knowledge; creating and monitoring development plans; setting performance expectations/goals; forecasting staffing needs and planning for peak times and absences; enforcing department policies and procedures.
