About The Position

The New York City Comptroller’s Office works to promote the financial health, integrity, and effectiveness of New York City government. The Bureau of Labor Law sets and enforces prevailing and living wage, and benefit rates for workers, laborers, and mechanics employed on New York City Public Work projects as well as building service employees on City contracts and certain properties that receive tax exemptions. The goal of the Worker’s Rights Bureau is to combat wage theft, expand worker’s rights and enforcement through legislation, policy, procurement, and corporate shareholder engagement initiatives, while strengthening the office’s outreach strategies to educate New Yorkers on their labor rights. The Bureau is seeking an experienced attorney with a labor law and/or litigation background to supervise entry-level attorneys, investigators, and paralegals in wage investigations and litigation in the Comptroller's Bureau of Labor Law. This position reports to the Bureau's Director of Enforcement.

Requirements

  • Admission to the New York State Bar
  • One year of satisfactory United States legal experience subsequent to admission to any state bar
  • Six months of satisfactory service as an Agency Attorney Interne (30086)
  • Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
  • To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
  • To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Responsibilities

  • Supervising 3-4 Bureau of Labor Law staff, including entry-level attorneys, investigators, and paralegals in the Bureau's wage enforcement actions. Review drafts, provide mentorship and feedback, and assist with litigation and negotiation strategies.
  • Lead complex investigations with teams consisting of legal and non-legal staff, including investigators and accountants.
  • Supervising junior attorneys in proceedings at the NYC Office of Administrative Trials and Hearings (OATH).
  • Assist attorneys in preparing for settlement conferences and hearings, review legal memoranda, and assist with preparations for trials.
  • Managing their own caseload of prevailing wage enforcement actions and the enforcement of other worker protection laws.
  • Performing other related work or special projects as needed, including outreach and education, presentations to stakeholders, and helping the office implement new laws such as Real Property Tax Law Section 485-x and the Construction Justice Act.
  • Performing other related duties as required.
