About The Position

The Florida Department of Health is one of the largest agencies in the State of Florida, which handles matters of public health, wellness and disease prevention. This role offers a unique opportunity to serve within both the Litigation Practice Group and the General Administrative, Regulatory, and Rule-Making Practice Group, providing the incumbent with broad exposure to the agency's diverse legal operations. As a key member of the Litigation Practice Group, the incumbent will represent the Department of Health in all courts of jurisdiction. Position duties include managing a caseload from discovery through trial, preparing all necessary motions and pleadings, conducting depositions, preparing and questioning witnesses, redaction and protection of confidential information, and conducting all aspects of hearings or trials. The incumbent will represent the Department in litigation matters primarily in state and administrative courts, with some federal court overlap. The incumbent will be responsible for managing their caseload, case tracking and will provide reports as requested. The incumbent will perform legal research, provide case analysis, make recommendations as to case strategy and represent the Department in court. The General Administrative, Regulatory and Rule Making Practice Group provides the Department with clear and consistent advice and counsel on general administrative matters, statutory/regulatory interpretations, legislative analysis, rule drafting and legal subject matter expertise regarding the agency’s substantive duties. This position is responsible for providing statutory/regulatory interpretations and guidance to assigned agency programs, preparing programmatic legislative analyses and legal reviews, drafting written legal opinions interpreting federal and state law, administrative rules, and case law, consulting with and advising staff on a variety of complex legal issues, reviewing all policies and procedures applicable to assigned headquarters activities and programs for legal implications, including the policy’s relationship to federal and state law, and providing oversight of agency rulemaking for assigned agency programs, including the drafting and review of administrative rules and is responsible for adopting rules pursuant to the Administrative Procedures Act. This position performs other duties as required by the assigned Chief Legal Counsels, the Deputy General Counsel, or the General Counsel. This is a dynamic, in-office position that will allow you to work directly with senior leadership, including the Chief Legal Counsels, Deputy General Counsel, and General Counsel.   • Litigation, rulemaking, or administrative law experience is preferred but not required.
