Requirements

  • Membership in good standing with the Florida bar
  • Two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.
  • Knowledge of legal terminology.
  • Knowledge of Florida laws and legal procedure.
  • Skill in reading comprehension, analysis, research, and organization.
  • Ability to provide legal counsel.
  • Ability to interpret state and federal legislation, laws, and rules.
  • Ability to employ legal reasoning and to foresee possible legal problems.
  • Ability to communicate effectively and concisely, both orally and in writing.
  • Ability to take action in situations which lack clear direction.

Responsibilities

  • Assist Chief Legal Counsel with supervision of Attorneys and Other Personnel in the Tallahassee office.
  • Provide legal advice to the Division of Health Quality Assurance, focusing on issues regarding the licensure and regulation of health care facilities, including statutory and rule interpretation, administrative rule development and rulemaking, responding to third parties, legislative bill analysis, and other functions.
  • Represent the Agency in civil and administrative proceedings in various forums, including the Florida Division of Administrative Hearings (DOAH), state trial courts, federal trial courts, and bankruptcy court. Litigation primarily involves administrative actions related to health care facility licensure and regulation, such as certificate of need actions, denial/withdrawal of license applications, administrative fines, petitions for waivers and variances, petitions for declaratory statements, rule development and rulemaking, federal bankruptcy matters, and denials of exemptions from disqualification from employment.
  • Sit as an informal hearing officer on Agency matters.
  • Work with Agency personnel in developing and reviewing proposed rules for legality, participate in rule development, workshops, and hearings, and defend proposed rule challenges.
  • Respond to general inquiries by the public and other agencies in a professional manner.
  • Respond to oral and written requests for legal opinions, ensuring they address the questions raised and are based on research, discussions, and exploration of facts.
  • Identify potential legal problems for AHCA and present them with proposed legal advice to the AHCA General Counsel's Office.
  • Perform other duties as assigned by the Chief Legal Counsel, Deputy General Counsel, General Counsel, and Agency Secretary.
