Pre-Litigation Attorney

Sweet James•Newport Beach, CA

About The Position

Sweet James Accident Attorneys is a rapidly growing, AI-powered personal injury firm based in Orange County, California. The firm describes its culture as focused on excellence, compassion, results, exceptional client experience, and collaboration, and says it invests in employees and encourages professional growth. The pre-litigation practice uses a pod model. Each pod pairs a Team Lead Attorney with dedicated case managers and firm-wide support teams. The attorney is responsible for knowing and resolving the pod’s cases, determining when files are ready for demand, reviewing and signing demands, negotiating with insurance carriers, and deciding the next course of action when offers are received. The attorney directs case managers on treatment and case workup, coaches them on medical issues and case flow, and handles consequential client conversations. Experienced attorneys lead a pod of case managers from the start. Attorneys earlier in their careers begin by handling cases directly and may earn case managers as they demonstrate their capability. This is a revenue-producing, client-facing role for an attorney who enjoys achieving results and working with people.

Requirements

  • Juris Doctor degree.
  • Active license to practice law in the state where the role is based.
  • Experience representing and communicating directly with individual clients; experience in personal injury or an adjacent plaintiff-side field is preferred, while criminal defense, workers’ compensation, prosecution, family, and immigration practice also qualify.
  • Comfort discussing money, medical treatment, and difficult news with clients.
  • Leadership by example: humility, willingness to take direction, doing what the case needs, and setting the tone for a team.
  • Goal-oriented, competitive, self-starting, and accountable for results.
  • Strong persuasion and negotiation instincts.
  • Ethical judgment and attention to detail.

Nice To Haves

  • Plaintiff-side personal injury experience, including negotiating with insurance carriers.
  • Experience leading or directing a team.
  • For recent graduates: client-facing clinic work, such as employment or injury clinics, or prior personal injury case management experience.
  • Daily use of a case management platform, such as Salesforce or Filevine.

Responsibilities

  • Review every file on the assigned pod and know the case, client, and case type.
  • Determine demand readiness based on treatment completion, receipt of records, and supporting liability; review and sign demands.
  • Negotiate with insurance adjusters to obtain the best offer and explain the result to clients.
  • Evaluate each offer and decide whether to pursue further treatment, open the policy, seek litigation review, or consider bad faith.
  • Direct case managers on treatment plans, liability investigation, and priorities; coach them on medical issues and case flow.
  • Handle client conversations that case managers cannot, including discussions about offers, resisted treatment recommendations, and resetting expectations.
  • Maintain a daily resolution cadence toward the pod’s revenue goal.
  • Maintain the pod’s files and data according to the firm’s hygiene standard.
