About The Position

This position oversees, observes, and develops trends to promote right of way efficiencies and provide for continuous improvement. It manages the property acquisition function to acquire land, easements, leases, licenses, and permits for capital projects. The role is responsible for managing right of way to protect title and interest, prevent encroachment, trespass, and environmental misuse. It also serves as a liaison with senior management, the Legal Department, and outside counsel regarding legal instruments and represents the Company in industry and professional associations. The Manager Right of Way oversees negotiations for land and easement acquisition, manages the preparation of appraisals and market studies, and provides guidance to Company personnel on right of way matters. Additionally, this role is responsible for maintaining accurate land rights records, developing and monitoring functional area budgets, and managing staffing levels, including selecting, developing, training, motivating, and evaluating employees.

Requirements

  • Bachelor's degree in Business, Real Estate, Engineering or related field and five years of progressively responsible professional experience in in the natural gas industry; or equivalent.
  • Excellent verbal and written skills so as to persuade and/or influence internal customers (including senior management) and external stakeholders (including landowners, attorneys, developers and governmental officials) on matters regarding easement/land rights, contractual issues and operational issues.
  • Ability to perform basic mathematical functions and algebraic operations.
  • Knowledge of various software applications to create documents, reports, and presentations.

Responsibilities

  • Recommends long and short term strategic plans to promote right of way efficiencies and provide for continuous improvement.
  • Oversees, observes and develops trends and takes necessary action as required.
  • Monitors and evaluates all right of way activities to assure compliance with federal, state and local regulations and Company policies, procedures, standards and safety requirements.
  • Manages the property acquisition function to acquire land, easements, leases, licenses and permits for the timely completion of capital projects.
  • Responsible for management of right of way to protect title and interest, prevent encroachment, trespass and environmental misuse.
  • Serves as liaison with senior management, Atmos Legal Department and outside legal counsel with responsibility for review and recommendation for the execution of legal instruments, including easements, encroachments, licenses, warranty deeds, blanket releases and other conveyance documents necessary for the successful construction, operation and maintenance of facilities.
  • Interacts with all levels of management to develop and achieve key strategies and objectives.
  • Oversees right of way negotiations and develops positive relationships with landowners, developers and governmental entities regarding encroachments, permissible usage, relocation / reimbursement obligations, and on-going operation / maintenance activities.
  • Represents the Company through participation in industry and professional associations.
  • Manages negotiations for acquisition of land and easement right of way to assure that good faith negotiations lead to agreement and if not, to a true impasse before recommending eminent domain proceedings.
  • Manages the preparation of appraisals and market studies to determine the fair value of land or easement right of way to be purchased or sold.
  • Responsible for providing assistance and guidance to Company personnel in matters relating to right of way and land rights.
  • Responsible for maintaining complete and up-to-date records that accurately reflect Company land rights including the timely filing of legal documents with various governmental entities.
  • Develops and monitors functional area budgets to assure efficient utilization of resources.
  • Plans and directs the achievement of area goals and objectives within established Company policies.
  • Maintains adequate staffing levels to assure proper administration of activities.
  • Selects, develops, trains, motivates and evaluates the performance of assigned employees.
