About The Position

The Kentucky Board of Cosmetology is seeking applications for the position of General Counsel. The Kentucky Board of Cosmetology’s mission is to serve the Commonwealth by providing educational, health, and regulatory standards for all aspects of the beauty industry. The Agency sets the standard for developing, advancing, and educating while ensuring the safety and protection of the Commonwealth. We will respond to emerging industry trends and issues, and implement appropriate regulatory strategies, striving to promote continued growth. We are looking for an individual that is highly motivated and organized with the ability to learn and adapt quickly.

Requirements

  • Juris Doctor degree from an ABA accredited law school
  • Minimum of eight years of experience as a licensed attorney
  • Must be admitted to practice law and in good standing in the Commonwealth of Kentucky

Nice To Haves

  • Prior experience representing a state agency in KRS 13B administrative proceedings
  • Experience drafting or reviewing KRS 13A rulemaking
  • Prior government in-house representation
  • Understanding of the legislative process in Kentucky

Responsibilities

  • Provide legal guidance, consultation and support to the board and board staff
  • Ensure compliance with open meetings and open records law
  • Supervise the Board’s Administrative Specialist Senior
  • Provide legal expertise concerning the application of the Board’s statutes and regulations to regulated entities
  • Draft documents for disciplinary case resolution, including agreed orders, complaints, notice of hearing and pre-hearing motions and responses
  • Draft all rulemaking while maintaining compliance with KRS 13A
  • Monitor relevant bills during legislative session and keep the Board and Board staff aware of changes
  • Represent the Board at legislative committee meetings
  • Track and help implement regulatory changes in state and federal law
  • Serve as the Board’s ethics officer
  • Review and negotiate agency contracts
  • Represent the Board in KRS 13B administrative hearings
  • Represent the Board in state and federal court
  • Assist with review of permit and license applications
  • Review grievances submitted to the board
  • Participate in settlement conferences with licensees and permit holders
  • Review expungement applications and present applications to the Board
  • Attend board committee meetings, providing materials and memorandums as requested and providing legal guidance and support
  • Monitor board regulation sunsetting and ensure board review prior to expiration
  • Coordinate as needed with other state and federal agencies
