The Enforcement Counsel resolves non-complex Enforcement matters and contributes meaningful high-quality work for large complex matters. This role involves executing risk-based legal strategies, assessing evidence, recommending fair outcomes, identifying risks and potential liabilities, and negotiating settlements. The Counsel will also contribute to internal legal strategy discussions, assist in litigation preparation, conduct witness examinations, and draft analytical and advocacy documents. A key aspect of this role is achieving foreseeable and transparent Enforcement outcomes in non-complex matters, including recommending charges and sanctions consistent with FINRA’s priorities and principles, and drafting clear settlement documents. The Counsel will also research legal requirements, identify ambiguities in rules and guidance, and explain legal reasoning to respondents and stakeholders. Timely resolution of non-complex matters is crucial, involving active monitoring of investigations, case preparation for litigation, and effective time management to meet deadlines. Collaboration with investigative staff is essential to produce a sound factual record, including planning investigations, providing legal advice, and ensuring written descriptions are accurate and supported by evidence. The role requires the ability to resolve non-complex matters with supervision and provide high-quality work in team-based settings, keeping managers informed and incorporating feedback. The Counsel will also assist in litigation preparation by preparing exhibits, drafting witness outlines, and participating in strategy discussions, as well as conducting non-complex witness examinations in litigation. Demonstration of FINRA’s values, including collaboration for investor protection and market integrity, is expected.
