DaVita’s in-house legal team is known as the “Justice League of DaVita” or “JLD”. The JLD is comprised of over [200] attorneys, paralegals, and professionals in countries around the globe. The Commercial Litigation team (“COLT”) is a division of the JLD. COLT is responsible for all commercial litigation matters including, for example, disputes with our payors, partners, landlords, and vendors; privacy-related disputes; and tax disputes. Role Overview: The Director, Corporate Counsel, Commercial Litigation (“COLT”) will be a member of a litigation team comprised of attorneys, paralegals, and legal professionals. The Corporate Counsel will proactively drive a portfolio of commercial litigation and arbitration matters – including payor, vendor, real estate and other business disputes – to resolution across the country in numerous venues. In addition, the Corporate Counsel will work collaboratively with other legal, business and clinical units to advise clients on various legal issues.

Requirements

  • J.D. degree from an accredited law school.
  • Must be admitted to practice and in good standing in at least one jurisdiction in the United States.
  • Between two and five years of general litigation experience, including experience managing all aspects of discovery and conducting motions practice.

  • Trial experience is a plus.
  • Experience taking depositions and/or arguing motions is a plus.
  • Experience clerking and/or working at a national or regional firm is a plus.
  • Experience with healthcare payor disputes, reimbursement/collections, or arbitration is a plus.

Responsibilities

  • Collaborating with internal business clients, other JLD colleagues, and outside counsel to develop strategies to achieve DaVita’s business goals.
  • Developing and executing litigation strategy for a multi-state portfolio of commercial litigation and arbitration matters, with a heavy emphasis on healthcare payor disputes and Accounts Receivable (AR) recovery.
  • Internal handling of legal disputes: analyzing legal claims; drafting demand letters; negotiating with opposing counsel; and drafting settlement agreements.
  • Managing and directing outside counsel to achieve business and litigation goals while ensuring appropriate legal staffing and billing compliance.
  • Providing legal guidance to internal business clients on an array of commercial litigation issues.
  • Supporting legal and operational leadership through clear and concise written and oral communication to understand the impact of litigation on the business.
  • Developing a thorough understanding of the company’s business as a critical component in formulating legal guidance.
  • Establishing a collaborative, working relationship with business clients.
  • Developing and executing various special assignments related to litigation or JLD priorities.
  • Participating in process improvement and establishment of best demonstrated practices.
  • Being an enthusiastic participant in the life of the legal department, including participating in team and JLD events and JLD committees.
