About The Position

The Division of Administration/Office of General Counsel has a vacancy. The Office of General Counsel provides professional legal services to the various offices within the Division of Administration. OGC’s trained team of attorneys, paralegals and support personnel also collaborate with legal representatives of other agencies, particularly in service areas provided by and through DOA. This attorney position represents the Division of Administration (DOA), Office of Group Benefits (OGB)—the statewide group health benefits plan with over a billion-dollar budget providing services to approximately 250,000 state employees, retirees, school board employees, and their dependents. The Division of Administration is the state government’s management arm and the hub of its financial operations. Division offices perform a wide variety of activities including the following: Overseeing the state’s capital construction program Working to provide state and federal grants for community development Development of the state budget Providing technology services Giving agencies guidance in the state purchasing and contracting process as they seek goods and services Administering a program that provides federal funds to help Louisiana residents recover from a series of devastating hurricanes.

Requirements

  • Possession of a current Louisiana license to practice law.

Responsibilities

  • Defends OGB on payment issues, coverage and contractual disputes, statutory penalty and attorney’s fees allegations, and eligibility matters both prior to and after suit has been filed.
  • Provides legal counsel to OGB executive management in the preparation of solicitations, review and evaluation of proposals, and the formation of complex and detailed contracts for health care delivery, plan administration, claims adjudication, technical and administrative services, life insurance, and other professional and consulting services involving expenditures of hundreds of millions of dollars.
  • Handles subrogation matters referred by OGB’s third-party administrator requesting settlement, including reviewing and evaluating documentation, retrieving OGB Medical Payments Summary Reports, calculating benefits, researching damage amounts, obtaining clarification or additional information from the OGB’s third-party administrator or the plan member’s attorney, negotiating with the plan member’s attorney, and proposing settlement recommendations to the OGB CEO or his designee.
  • The incumbent is expected to be familiar with public records law and the handling of public record requests, including but not limited to, scrutinizing documents submitted by an agency in response to a request; determining whether the documents are subject to production or excluded therefrom; redacting the documentation for privileged and confidential information; and communicating with the agency and requestor as well as any other appropriate person (e.g., a proposer).
  • Assists with the Commissioner’s administrative appeal process, advising on and drafting decisions for administrative appeals to the Commissioner based on a review and examination of the appeal, the underlying documents (Requests for Proposals, proposals, responses to public records requests, etc.), and the related procurement rules and case law.
  • Performs various duties for the Office of General Counsel on an as-needed basis at the direction of the Executive Counsel
