About The Position

This is a part-time position. Attorney I: Performs entry-level to routine (journey-level) legal work. Works under moderate supervision, with limited latitude for the use of initiative and independent judgment. Employees may occasionally assist others performing job duties of greater complexity. This position is primarily responsible for ensuring the agency’s compliance with the Public Information Act and the agency’s records management function. The position also assists with directing and coordinating the agency's response to litigation, including coordinating and responding to subpoenas and depositions. The position also provides legal counsel on legislation, rules, and contracting. Attorney II: Performs moderately complex (journey-level) legal work. Works under general supervision, with moderate latitude for the use of initiative and independent judgment. Employees at this level may provide guidance to others. This position is primarily responsible for ensuring the agency’s compliance with the Public Information Act and the agency’s records management function. The position also assists with directing and coordinating the agency's response to litigation, including coordinating and responding to subpoenas and depositions. The position also provides legal counsel on legislation, rules, and contracting.

Requirements

  • Graduation from an accredited law school with a Juris Doctor (JD) degree.
  • For Attorney I -- Experience in legal work.
  • For Attorney II – Two (2) years full-time legal experience
  • Possess a valid Texas driver’s license.
  • Member in good standing with the State Bar of Texas.
  • Licensed as an attorney by the State of Texas.
  • Ability to plan and organize work, to conduct and advise on hearings, to prepare opinions and briefs, to assist in the preparation of cases for trial, to conduct research, to summarize findings, to interpret and apply laws, to use legal reference materials, and to communicate effectively.
  • Ability to review documents for accuracy, completeness, and compliance.
  • Required to work as a team member and work with and appropriately safeguard sensitive and confidential information.

Nice To Haves

  • Experience with the Texas Public Information Act.
  • Knowledge of Texas records management laws and rules.
  • Experience in administrative law, state procurement laws, and/or litigation.
  • Knowledge of legal principles, practices, and proceedings; of state and federal laws, rules, and regulations; and of agency administrative rules and regulations.
  • Working knowledge of the Texas Public Information Act and administrative law.
  • Skill in legal research, writing, and analysis; in the use of a computer and applicable software (e.g., Microsoft Suite, Adobe Acrobat); in using reasoning and logic; in identifying and solving complex problems; in prioritizing workloads; and in using judgment to identify courses of action.
  • Superior organizational and time management skills.

Responsibilities

  • Assists in overseeing the agency’s open records and records retention processes.
  • Coordinates the processing of open records requests and expunctions, including performing legal analysis and drafting requests for ruling to the Office of the Attorney General.
  • Handles related assignments to meet the goals, objectives, and mission of the agency.
  • Provides legal support for agency records retention policy and process to ensure compliance with the records retention schedule.
  • Assists with directing and coordinating the agency's response to litigation.
  • Acts as a liaison with the Office of the Attorney General regarding litigation in which the agency is a party or interested third-party.
  • Coordinates and responds to subpoenas and depositions.
  • Drafts and reviews legal documents necessary to all job duties, including rules, legal opinions, briefs, contracts, reports, and amendments for legislative consideration.
  • Reviews laws, rules, and regulations affecting agency operations and administration.
  • Assists in negotiating, drafting, reviewing, and/or making recommendations on agency contracts and procurements.
  • Reviews and drafts bills and amendments for legislative consideration and supports rule promulgation and policy development.
  • Performs related work as assigned.

Candidates meeting these requirements will be offered a lower base salary to cover the surcharge.
