About The Position

We are seeking an experienced and innovative attorney with expertise and a strong track record of enabling product development and negotiating strategic commercial partnerships in the financial services and/or healthcare fields. The Associate General Counsel, Product and Growth is responsible for our legal strategy and enabling the company’s compliant execution of its product and growth strategies as we develop new products and services, key strategic commercial partnerships, and other areas of innovation and growth. This role will provide strategic guidance to develop and bring to market new products and services ensuring regulatory compliance, IP protection, and risk mitigation. In doing so, this role will navigate multiple regulatory frameworks and apply them in new or novel settings. This role will be a key partner in enabling the execution of HealthEquity’s key strategic initiatives and future growth in a compliant and customer-focused manner. You will serve as a trusted advisor to enable the company to navigate innovative product and service offerings and partnerships. As part of a collaborative team, you will deliver practical, business-oriented legal guidance to apply applicable laws, regulations, policies, and best practices to new products and services. You will partner with business leaders in the technology, product, service delivery and marketing teams to anticipate needs, craft agile governance frameworks, and align risk management with growth priorities. You will constantly address unique legal issues at the intersection of employee benefits, healthcare, and financial services. In doing so, you will find that the Legal Department is a key enabler and strategic partner in all aspects of HealthEquity’s growth.

Requirements

  • J.D. from an ABA-accredited law school with an active license to practice in at least one U.S. jurisdiction
  • 10+ years of experience advising on product development in regulated industries at a top law firm or with a combination of applicable in-house legal work
  • Experience advising all levels of management, including C-suite executives, and board members on new product development and strategic partnerships with clear presentation of risks, potential impacts, solutions and risk management strategies
  • Experience advising on new products and services within the banking/finance and healthcare industries
  • Experience in regulated industries and data privacy regulatory compliance
  • Experience in marketplaces
  • Ability to synthesize complex legal issues, issue spot, engage appropriate subject matter expertise and provide practical risk management advice
  • Ability to learn new regulatory regimes quickly and apply practical guidance for the team
  • Ability to identify solutions and drive the business forward

  • Ideal candidate will have expertise in UDAP, financial regulations, ERISA welfare benefit plans, HSAs and other consumer directed benefits, GLBA and HIPAA

Responsibilities

  • Manages and carries out the personnel actions for direct reports, including but not limited to hiring and scheduling; training and evaluating; coaching and managing performance; making salary, merit, or other compensation recommendations for team of direct reports; and making recommendations and/or taking corrective or disciplinary action as appropriate.
  • Advise on complex legal and regulatory issues relating to consumer facing products and services
  • Review, draft and negotiate agreements and provisions relating to strategic commercial partnerships, and new products and services.
  • Assess legal risk associated with new products and services, align with internal stakeholders quickly, recommend safeguards, and guide business teams toward compliance and practical solutions
  • Embed Legal team partnership through the new product development lifecycle
  • Partner and collaborate with other internal and external counsel and various teams to understand regulatory, product, engineering, design and operational implications of new products and services
  • Mature and maintain an intellectual property management program and partner with the People and Product teams in developing innovative frameworks for IP development
  • Translate new and emerging laws into actionable, effective legal guidance
  • Identify and support process improvements to promote agility in legal and related business operations
