About The Position

The Office of General Counsel is seeking to hire a dynamic, collaborative, detail-oriented licensed attorney in Illinois to serve as an Assistant General Counsel for Privacy. The Assistant General Counsel for Privacy will report to the Deputy General Counsel for HIPAA, FOIA, and Privacy. The Assistant General Counsel will conduct investigations and coordinate responses to external entities of alleged breaches of the Health Insurance Portability and Accountability Act of 1996, the Personal Information Protection Act, and other privacy statutes. The Assistant General Counsel will provide guidance on privacy statutes to Department staff, including reviewing and updating Department policies and training local privacy officers.

Requirements

  • Requires graduation from a recognized school of law.
  • Requires possession of a license to practice law in Illinois.
  • Requires three (3) years of experience in the practice of law.

Nice To Haves

  • Two (2) years of professional experience as a licensed attorney advising on compliance with the Health Insurance Portability and Accountability Act of 1996, the Personal Information Protection Act, or other similar privacy statutes.
  • Two (2) years of professional experience as a licensed attorney conducting internal investigations into cyber security matters, data breaches, or similar matters involving regulatory compliance.
  • Two (2) years of professional experience responding to Freedom of Information Act requests and/or litigating Freedom of Information Act cases.
  • Three (3) years of professional experience as a licensed attorney working on compliance with governmental regulations.
  • Three (3) years of professional experience providing legal advice to management in a governmental, social services, healthcare, educational, and/or technology organization.
  • Three (3) years of professional experience as a licensed attorney reviewing and advising on proposed changes to statutes, administrative regulations, or internal policies and conducting legal research and preparing written memoranda.

Responsibilities

  • Serves as Assistant General Counsel for Health Insurance Portability and Accountability Act (HIPAA) and Privacy.
  • Coordinates responses to HIPAA and PIPA breaches.
  • Drafts guidance memos to management and local privacy officers on compliance with HIPAA, PIPA, and other privacy statutes.
  • Assists with general legal work in the Office of General Counsel such as responding to subpoenas, search warrants, and releases of information; reviewing contracts and other legal agreements; reviewing and commenting on legislation; and conducting legal research.
  • Performs other duties as assigned or required which are reasonably within the scope of duties enumerated above.
