About The Position

The Civil Rights Section of the Litigation Division of the Utah Attorney General's Office seeks an attorney to represent state employees, state agencies, school districts and universities in civil rights, Title IX, Title VI and ADA litigation. Applicants must have the ability to analyze complex legal problems, apply legal principles, prepare legal documents, and present arguments clearly, persuasively and logically. Applicants must also have at least 3 years of civil litigation experience. Some travel may be required. A successful candidate must have excellent oral advocacy and superior writing skills, the ability to analyze complex legal problems, apply legal principle, experience reviewing and managing large volumes of documents, legal research abilities, and the ability to build rapport and work cooperatively with client agency representatives. Membership in good standing in the Utah State Bar, or qualification for practice pending admission to the Utah Bar under Utah Supreme Court Rule of Professional Practice14-809, is required. Some travel is required as incumbents will need to represent their clients in civil litigation and other legal proceedings throughout the state.

Requirements

• A Juris Doctorate is required.
• Active membership in the Utah State Bar required.
• Communicate information and ideas clearly and concisely in writing; read and understand information presented in writing
• Read, interpret, and apply laws, rules, policies and procedures.
• Knowledge of legal processes and procedures.
• Use logic to identify and analyze underlying principles, reasons, and facts to draw correct conclusions.
• Knowledge of Rules of Evidence.
• Perform legal research using appropriate techniques and systems.
• Conduct settlement negotiations and arrive at suitable terms when appropriate and advisable.
• Relate to people in sensitive, tactful and professional manner.
• At least three years of civil litigation experience.

Responsibilities

• Prepares cases by conducting legal research and gathering evidence.
• Writes or drafts court filings (motions to dismiss, motions for summary judgment), correspondence and/or other legal materials.
• Consults, makes recommendations and gives appropriate advice decisions pertaining to client interests
• Determines needs in discovery, and/or completes discovery; participates in decision making and strategy sessions to prepare cases for court and determine the necessary evidence.
• Represents state entities and their officials in lawsuits involving the First, Fourth, and Eighth Amendment litigation, and educational institutions in Title VI, Title IX, and tries cases in federal court.
• Occasionally may be required to travel to various locations and stay overnight
