About The Position

ATA Services is seeking a part-time legal professional with strong experience with trusts, elder law and/or Medicaid to support Denver's Department of Health Care Policy and Financing. This contract position is expected to last until June 30th, 2027, with possible extension. The role requires approximately 20 hours per week (40 hours per month), with flexible hours between 9 am - 3 pm, and a mandatory meeting on Wednesdays from 11 am - 12 pm. The position is remote, but requires onsite visits for equipment pickup and drop-off at the start and end of the contract.

Requirements

  • Law degree or a bachelor's degree from an accredited institution in accounting and finance, public policy or in any other field of study related to these duties.
  • Five years' experience drafting or reviewing and interpreting trust instruments; and/or administering trusts, including involvement in the decisions related to trust distributions and the preparation or review of trust accountings and tax filings.

Responsibilities

  • Reviewing and interpreting trust agreements and other legal documents for individuals applying for medical assistance programs
  • Preparing and issuing trust determination letters to medical assistance eligibility offices
  • Conducting legal research and applying federal and state regulations to trust-related eligibility decisions
  • Analyzing trust accountings to identify compliance concerns and eligibility issues
  • Managing recovery of remaining trust balances payable to the Department upon trust termination
  • Assisting with administrative appeals and legal proceedings in partnership with the Colorado Attorney General's Office
  • Providing guidance and recommendations regarding trust compliance and Medicaid eligibility requirements
