About The Position

Under general direction, performs a wide variety of technical and legal duties in the Cannabis Unit within Administration Section of the Office of Legal Affairs. Provides legal counsel and assistance, conducts extensive and complex legal research and/or studies, provides subject matter guidance on Freedom of Information Act (FOIA) requests, provides support to the Rules Coordinator in the revision of rules for the administration of cannabis law and rules, and prepares legal positions relative to certain legislation. Serves as a spokesperson for the Department, confers with the Illinois Attorney General's Office, and prepares, reviews, and coordinates contracts entered into by the Department.

Requirements

  • Graduation from a recognized law school.
  • Possession of a valid license to practice law in Illinois.
  • In the previous 4 years, at least 12 months of experience (not necessarily consecutive) where a majority of the months’ time was spent providing legal counsel to entities in the cannabis industry or government agencies that regulate entities in the cannabis industry.
  • In the previous 4 years, at least one year of experience working full-time as a litigator or judicial law clerk (civil, criminal, or administrative).
  • In the previous 4 years, at least one year of experience in roles that regularly required drafting proposed legislation or proposed administrative rules.
  • Ability to travel.
  • Possession and the ability to maintain a valid license to practice law in Illinois.
  • Must file a Statement of Economic Interest.
  • Awareness of revolving door restrictions.

Responsibilities

  • Performs technical and legal work of a general nature, involving responsibility for recommending administrative action on problems relating usually to one field of regulations or activity; conducts administrative hearings, legal hearings, and litigates matters before administrative tribunals.
  • Conducts extensive and complex legal research and/or studies.
  • Provides subject matter guidance on Freedom of Information Act (FOIA) requests which pertain to the disclosure of public records related to the Department’s regulation of cannabis.
  • Provides support to the Rules Coordinator in the revision of rules for the administration of cannabis law and rules.
  • Prepares legal positions relative to certain legislation, both current and proposed, as to the effect on the Director, the Department, and/or the licensing process.
  • Confers with Legislators, private and staff attorneys, the public, etc., on problems of statutory interpretations and compliance relating to licensure and rulemaking.
  • Confers with the Illinois Attorney General's Office regarding litigation cases of a sensitive and confidential nature involving the Department.
  • Prepares, reviews, and coordinates contracts entered into by the Department.
  • Performs other duties as required or assigned which are reasonably within the scope of the duties enumerated above.
