About The Position

Act as primary contact and leader of each project from acceptance of contingent financing to loan closing. Comply with all SBA SOP regulations and ensure all bank policy and procedures are followed to ensure the loan guaranty is sound by using critical thinking and judgment to identify potential fraud or irregularities that might jeopardize the SBA Loan guaranty.

Requirements

  • A 4-year college degree in a business related field or equivalent
  • 10+ years in commercial real estate loan closings or 7+ years in SBA loan closings.
  • A Paralegal DOE may be considered an equivalent level of experience with 5 years of commercial loan closings.
  • MS Office Suite
  • work with minimum supervision
  • ability to make independent decisions within authority

  • prior title commitment review experience preferred

Responsibilities

  • Close SBA loan transactions while adhering to established/aforementioned closing policies of 44 Business Capital, Berkshire Bank and, most importantly, the SBA SOP.
  • Ensure that all loans are closed in compliance with SBA SOP’s and individual Terms & Conditions.
  • Review and analyze documentation submitted to satisfy conditions of approval. Summarize and Report irregularities to Director of Closing or Credit Underwriter for further review.
  • Work with post-closing to resolve any post-closing audit exceptions to eliminate risk and clear tracking items.
  • Interact with Closing Counsel on legal matters which arise during the closing process. Work with Director of Closing, and/or Underwriter to address closing issues in a timely manner.
  • Review and Analyze documentation submitted by conditionally approved applicant to clear conditions for closing.
  • Review and compare tax transcripts with borrower submitted tax returns for irregularities; report variances to Director of Closing for review.
  • Validate eligibility from applicant submitted SBA 1919 within Etran.
  • Track all expenses associated with each loan to monitor expenses versus the good faith deposits we have from borrowers.
  • Generate closing checklists for all loans upon acceptance of commitment.
  • Collect and review all items on the checklist and coordinate the collection of these items with closing counsel.
  • Ensure you have followed the post-Closing process for handing off loan to Post-Closing Team for review, (Exception follow-up and imaging into FCM Image Centre).
  • Handle any SBA related Post Closing Items for ETRAN to include upload T&C, executed Form 159 and update any fields in ETRAN for 1502 Reporting.
  • Assist where needed in general office administration (i.e. IT, efficiency/quality suggestions, operational procedures, marketing, answering calls, etc.). The small office environment requires all employees keep a finger on the pulse of general business operations which may fall outside their immediate realm of responsibility.
  • Ensures compliance with all banking laws, rules, regulations, and prescribed policies/practices/procedures necessary to reduce risk and uphold ethical standards related to and required by one’s duties.
