About The Position

Supermicro is seeking a strategic Sr. Legal Counsel, Litigation & Internal Investigations to lead internal investigations, support litigation, oversee e-discovery, and handle government inquiries. This role involves collaboration across Legal, Compliance, HR, Internal Audit, Information Security, and business teams. Strong experience in sensitive investigations, regulatory matters, commercial disputes, document preservation, export controls, and government enforcement is highly valued. Candidates with mixed government, law firm, and/or in-house backgrounds are preferred.

Requirements

  • J.D. from an accredited law school.
  • Active membership in at least one U.S. state bar, CA preferred.
  • 8 plus years of relevant legal experience.
  • Significant experience conducting investigations and managing litigation matters.
  • Experience taking or preparing witnesses for interviews and depositions.
  • Strong written and oral communication skills.
  • Ability to handle sensitive and highly confidential matters with discretion.
  • Strong organizational, project management, and analytical skills.

Nice To Haves

  • Combination of government and law firm experience.
  • Experience with federal or state enforcement agencies, U.S. Attorney's Offices, DOJ, SEC, BIS, OEE, OFAC, or similar regulatory bodies.
  • Experience conducting corporate internal investigations.
  • Familiarity with e-discovery platforms, document review workflows, and litigation hold processes.
  • Experience responding to subpoenas, government inquiries, and regulatory investigations.
  • Experience supporting technology, manufacturing, hardware, semiconductor, export-control, or other highly regulated industries.

Responsibilities

  • Lead and support investigations into compliance, ethics, misconduct, fraud, conflicts of interest, export controls, anti-corruption, and related issues.
  • Develop investigation strategies, conduct interviews, assess evidence, prepare findings, and advise on outcomes and remediation.
  • Coordinate with internal teams and outside counsel on investigations and refine investigation protocols.
  • Oversee commercial, employment, regulatory, and other civil disputes.
  • Manage outside counsel for quality and cost-effectiveness.
  • Support case strategy, discovery, motions, trial preparation, and witness/deposition preparation.
  • Evaluate risk and advise business leaders on litigation matters.
  • Respond to subpoenas, CIDs, inquiries, and investigations from government and regulatory bodies.
  • Coordinate fact-gathering and document collection for government and regulatory matters.
  • Liaise with federal, state, and international agencies alongside internal stakeholders and counsel.
  • Manage litigation holds and preservation of documents.
  • Oversee collection, review, production, and privilege review of documents, and manage vendors.
  • Partner with IT on data handling and advise on hold and records obligations.
  • Improve e-discovery and information governance legal operations.
  • Deliver practical legal advice and identify risks and mitigation strategies.
  • Support training on investigations, litigation readiness, preservation, and compliance.
  • Contribute to department policies and best practices.
