About The Position

Five Below is seeking a Regulatory and Compliance Attorney to build, implement, and oversee a comprehensive regulatory compliance program for one of the nation’s fastest-growing value retailers. As Five Below continues to expand its store footprint and product assortment, the volume, breadth, and velocity of the products it sells create a dynamic and increasingly complex regulatory environment. This role is central to ensuring that the products Five Below offers meet all applicable federal, state, and local requirements before they reach the shelf, protecting both our customers and the Five Below brand. Reporting into the Chief Legal Officer, the Regulatory and Compliance Attorney will serve as a principal architect and steward of Five Below’s enterprise-wide regulatory compliance program. While the role carries a primary emphasis on product compliance—including product safety, chemical compliance, labeling, and packaging—product compliance is only one component of a broader mandate. As a publicly traded company with a global sourcing footprint, Five Below is subject to a wide range of legal and regulatory obligations, and this role is responsible for helping to build and oversee a program that addresses compliance holistically. This includes anti-corruption and anti-bribery (e.g., the Foreign Corrupt Practices Act (FCPA)), advertising, marketing and labelling compliance, supply chain and vendor compliance, data privacy and cybersecurity, corporate responsibility obligations, and public-company governance and disclosure requirements. The position is strategically important because Five Below’s business model depends on sourcing and selling a high-volume, rapidly refreshed assortment of goods across a global supply chain; disciplined, proactive compliance across all of these areas is essential to sustaining that model while mitigating regulatory, financial, and reputational risk. The attorney will partner closely with Legal, Compliance, and cross-functional business teams to embed compliance into the product lifecycle and translate complex legal requirements into practical, business-focused guidance in a fast-paced national retail environment. This is a builder’s role for a regulatory attorney who thrives on establishing and scaling programs, is comfortable operating with autonomy, and can move fluidly between technical regulatory analysis and pragmatic business counsel.

Requirements

Juris Doctor (JD) from an accredited law school
Active member in good standing of at least one U.S. state bar, with the ability to satisfy any in-house registration or licensing requirements applicable in the jurisdiction where the role is based.
Six (6) to ten (10) years of relevant legal experience in regulatory and compliance matters, whether at a law firm, in-house legal department, or regulatory agency
Prior in-house experience building and managing a compliance program from the ground up.
Substantive knowledge of product safety and consumer protection frameworks, including CPSC, CPSIA, and FTC requirements, and the ability to apply them in a practical retail context.
Working knowledge of broader corporate compliance frameworks relevant to a global, publicly traded company.

Nice To Haves

Direct experience supporting consumer packaged goods, retail, or manufacturing businesses, particularly in a high-volume or value retail environment.
Experience at an international or global company is strongly preferred, with a particular emphasis on the retail industry.
Experience advising on chemical compliance (such as Proposition 65 and TSCA), labeling and packaging requirements, import and customs compliance, and product recalls is highly desirable.
Familiarity with public-company compliance considerations—including anti-corruption, corporate responsibility, and governance and disclosure obligations.
Prior experience building or scaling an enterprise-wide compliance program.
Demonstrated growth mindset and the ability to act and react quickly in a fast-paced, rapidly evolving environment.

Responsibilities

Enterprise Compliance Program Design and Management. Design, implement, and continuously enhance a comprehensive, enterprise-wide regulatory compliance program, together with supporting policies, controls, and procedures, tailored to a high-volume, value retail environment that sells products across a broad and frequently changing assortment. Ensure the program addresses the full range of compliance domains applicable to a global, publicly traded retailer, with product compliance operating as one integrated component of a broader framework. Establish scalable processes and governance structures that keep pace with Five Below’s growth and evolving product mix.
Regulatory Monitoring and Advisory. Monitor, interpret, and advise on federal, state, and local regulations, including but not limited to requirements administered or established by the Consumer Product Safety Commission (CPSC), the Food and Drug Administration (FDA), and the Federal Trade Commission (FTC), as well as California Proposition 65, the Toxic Substances Control Act (TSCA), the Federal Hazardous Substances Act (FHSA), applicable ASTM International standards, and product labeling requirements. Provide clear, risk-based guidance to business teams on how these requirements apply to specific products and categories.
Product Compliance Support Support legal aspects of product compliance spanning chemical safety, labeling, packaging, and warnings, as well as import and customs compliance for goods sourced domestically and internationally. Support the regulatory aspects of product launches, modifications, and discontinuations, and advise on certifications and testing requirements.
Cross-Functional Partnership. Partner cross-functionally with merchandising, sourcing, product development, and supply chain teams to embed compliance into product lifecycle processes, from concept and vendor selection through sourcing, procurement, and vendor agreements. Serve as a trusted advisor who enables business objectives while ensuring adherence to applicable requirements.
Training and Education. Develop and deliver compliance training programs for internal stakeholders, providing guidance and mentorship that promotes a strong, enterprise-wide culture of compliance.
Legislative and Regulatory Tracking. Track legislative and regulatory developments and enforcement trends affecting the retail industry, and proactively advise leadership on emerging risks and their potential business impact.
Anti-Corruption and Ethics Compliance. Develop, maintain, and monitor anti-corruption and anti-bribery policies and controls, including compliance with the Foreign Corrupt Practices Act (FCPA) and applicable international anti-bribery laws, and advise on third-party due diligence, gifts and entertainment, and related risk areas across Five Below’s global sourcing and vendor relationships.
Responsible Sourcing and Supply Chain Compliance. Advise on responsible sourcing and supply chain integrity obligations, including conflict minerals due diligence and reporting, forced labor and modern slavery requirements, and supplier codes of conduct, and integrate compliance requirements into sourcing, procurement, and vendor agreements.
Trade, Customs, and Sanctions Compliance. Advise on import and customs compliance, export controls, and economic sanctions applicable to a global supply chain, coordinating with sourcing and logistics teams to manage cross-border regulatory risk.
Data Privacy, Cybersecurity, Corporate Responsibility, and Governance. Support compliance with U.S. privacy and cybersecurity laws (e.g., CCPA/CPRA and other state regimes), corporate responsibility obligations, and public-company governance and disclosure requirements, coordinating with privacy, information security, sustainability, and corporate governance stakeholders.
Regulatory Inquiries, Recalls, and Enforcement. Support and help lead responses to regulatory inquiries, examinations, internal investigations, product recalls, corrective actions, and enforcement matters, including strategy, regulator communications, and document production. Play a central role in incident response, remediation, and crisis management related to product and broader compliance issues.
