About The Position

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions. Some key position details are: - Defending DHSR before the Office of Administrative Hearings (OAH) and State trial and appellate courts in licensure and penalty enforcement actions against adult care homes; mental health facilities; hospitals; nursing homes; home care agencies; ambulatory surgical facilities; emergency medical services providers; hospice facilities; and facilities and agencies engaged in the sale, use, maintenance, and disposal of radioactive materials and machines; - Representing DHSR in all licensure-related actions filed in State and federal trial courts, and in all subsequent appeals; - Advising DHSR on a wide variety of legal matters; - Representing DHSR in the administrative rulemaking process before the NC Medical Care Commission, NC Radiation Protection Commission, NC Childcare Commission, and the NC Rules Review Commission; - Representing the State in criminal appeals. Some travel, including some occasional overnight stays are required

Requirements

  • Licensed to practice law by the North Carolina State Bar and one year of professional legal experience.

Nice To Haves

  • 2 years of progressively responsible civil litigation experience
  • Experience in healthcare, administrative, and/or regulatory law
