About The Position

The Senior Staff Attorney (Attorney 4) position will provide legal representation and services to the Industrial Commission of Arizona, including to its members, Director, Deputy Director, and the Commission's various divisions, to include: the Special Fund in uninsured workers' compensation claims, second injury claims, supportive care claims, and matters involving A.R.S. §§ 23-961 & 23-1065; the Arizona Division of Occupational Safety and Health in matters involving the enforcement of the Arizona Occupational Safety and Health Act; the Labor Division in enforcement of youth employment matters, wage claim appeals, and other matters under the Labor Division's jurisdiction.

Requirements

  • Graduation from an accredited college of law.
  • Admission to, and good standing with, the Arizona State Bar.
  • Active Arizona State Bar license.
  • Possession and retention of a current, valid class-appropriate driver’s license if operating a motor vehicle on State business.
  • Completion of all required driver training and successful passing of driver's license record checks.
  • Maintenance of acceptable driving records.
  • Completion of all required driver training.
  • Maintenance of statutorily required liability insurance if operating a personally owned vehicle on state business.
  • Successful completion of the Electronic Employment Eligibility Verification Program (E-Verify).

Nice To Haves

  • Minimum of 5 years’ experience in areas of law related to workers' compensation, OSHA, labor/employment, administrative practice and procedures, appellate practice and procedure, superior court practice and procedure, rulemaking, contracting and procurement, open meetings, public records, insurance, collection practices, and bankruptcy/receivership/liquidation.

Responsibilities

  • Provide legal representation and services to the Industrial Commission of Arizona, its members, Director, Deputy Director, and various divisions.
  • Handle matters related to the Special Fund, including uninsured workers' compensation claims, second injury claims, supportive care claims, and specific A.R.S. sections.
  • Represent the Arizona Division of Occupational Safety and Health in matters concerning the enforcement of the Arizona Occupational Safety and Health Act.
  • Engage in enforcement of youth employment matters, wage claim appeals, and other issues under the Labor Division's jurisdiction.
  • Provide advice regarding personnel matters and record requests.
  • Assist the Commission with legislative matters and rule-making.
  • Represent the Commission in efforts to ensure employer compliance with A.R.S. § 23-961.
  • Pursue subrogation of third-party no-insurance claims.
  • Collect money owed to the agency/state.
  • Utilize the ICA case management and paperless file systems to maintain electronic files and databases for all assigned matters.
  • Potentially work remotely within Arizona, based on business needs and performance.
