About The Position

Thompson Law is seeking a Senior Pre-Litigation Attorney to lead and manage the pre-litigation docket in their Dallas, Texas office. This role is for an experienced personal injury lawyer focused on settlement strategy and execution, rather than courtroom litigation. The attorney will oversee a pre-litigation team, including paralegals, demand writers, and other support staff, to guide cases from intake through settlement and disbursement. The primary focus will be on case selection, medical build-up, valuation, demand writing, and negotiation to achieve the best possible outcomes for clients without the need for litigation. When a case requires litigation, it will be transferred to the firm's litigation team. The role involves strategic decision-making, quality control, client advocacy, and mentoring junior attorneys and support staff. The attorney will also contribute to firm-wide pre-litigation strategy and growth.

Requirements

  • Licensed to practice law in Texas and in good standing with the State Bar of Texas.
  • 8+ years of legal experience, with substantial personal injury experience (plaintiff or defense).
  • Demonstrated record of valuing and settling personal injury cases at full value, including policy-limits and high-exposure claims, efficiently.
  • Proven ability to evaluate liability and coverage, direct medical build-up, set settlement parameters, manage a docket, and direct support staff.
  • Working knowledge of hospital, health-plan, ERISA, Medicare, and Medicaid liens and their resolution.
  • Demonstrated success leading teams in a fast-paced, high-volume legal environment.
  • Clear communication skills, ability to remain steady under pressure, and problem-solving aptitude.
  • Persuasive written and verbal communication skills with clients, adjusters, medical providers, and colleagues.
  • Proficiency with legal research databases, case management software, and modern legal technology, including AI.

Nice To Haves

  • Experience with catastrophic injury, wrongful death, commercial trucking, or premises cases.
  • Prior litigation or trial experience.
  • Spanish speaking ability.

Responsibilities

  • Lead the pre-litigation docket, driving strategy on liability, coverage, damages, and valuation from intake through settlement and disbursement.
  • Make final decisions on case acceptance based on liability, coverage, and damages.
  • Guide treatment paralegals and providers to ensure proper medical build-up and identify potential policy-limits cases.
  • Review and approve all demand packages, ensuring strategic soundness, accurate valuation, and appropriate settlement parameters.
  • Set settlement parameters, engage in complex negotiations, and determine when cases should be transferred to litigation.
  • Approve reduction worksheets and final distributions, ensuring accurate lien resolution (hospital, health insurance, ERISA, Medicare, Medicaid) to maximize client net recovery.
  • Supervise and mentor the support team, conduct file reviews, and set standards for excellence.
  • Serve as a trusted advisor to clients regarding their treatment, case progress, and settlement decisions.
  • Collaborate with firm leadership to refine pre-litigation strategy and contribute to firm growth.
