About The Position

Hydro One is seeking a Paralegal to analyze, assess, prosecute, and defend liability and damage claims under the direction of a Supervisor or other solicitors. This role involves supervising agents in the prosecution and defense of claims, processing claims through the Superior Court of Justice (Provincial Court Civil Division - Small Claims Court & Simplified Procedure), and assisting solicitors with legal proceedings. Responsibilities include investigating, interviewing witnesses, organizing court documents, preparing affidavits, drafting pleadings, preparing standard court forms, filing and serving documents, drafting correspondence, engaging in settlement discussions, and preparing files for Pretrial and Trial. The Paralegal will also liaise with retail claims to process Bankruptcy Proofs of Claim, conduct investigative searches, and assist internal Labour/Employment Counsel with research and preparation for grievances, arbitrations, and Labour Relations Board submissions. Additionally, the role involves training and supervising law students and law clerks in Small Claims Court proceedings.

Requirements

  • Analyze, assess, prosecute, and defend liability and damage claims.
  • Supervise the prosecution and defense of claims by agents on the Company’s behalf.
  • Process claims through the Superior Court of Justice (Provincial Court Civil Division - Small Claims Court & Simplified Procedure).
  • Assist other solicitors in processing legal proceedings by investigating, interviewing and organizing and summonsing witnesses, organizing court documents, preparing Affidavits of Documents, drafting pleadings for Supervisor and other solicitors, as required.
  • Prepare standard court forms, file documents and process serving court documents; draft correspondence; engage in settlement discussions and settle claims; prepare files for Pretrial and Trial, including trial briefs, as required.
  • Liaison with retail claims to process Bankruptcy Proofs of Claim.
  • Conduct standard corporate, personal property and other investigative searches for claims.
  • Assist internal Labour/Employment Counsel with the research of data and preparation for grievances and arbitrations, submissions to Labour Relations Board and confidential labour/employment matters.
  • Train and supervise law students and law clerks in all aspects of Small Claims Court proceedings.
  • Assess and process claims, whether contractual or tortious, to be handled within the jurisdiction of Superior Court of Justice (Provincial Court) (Civil Division - Small Claims Court & Simplified Procedure).
  • Receive assignments from Supervisor or other solicitors, Accounts Receivable and other clients to determine the validity of claim relative to limitation period and dollar value to ensure that the claim does not exceed Small Claims Court jurisdictional limits.
  • Make recommendations to Supervisor or appropriate line management whether to prosecute for damages, to defend Hydro One’s position or take other action.
  • Prepare necessary forms, court documents, etc, file documents in the appropriate Small Claims Court or Superior Court and appear or supervise agents to obtain judgement favourable to Hydro One.
  • Conduct Pretrial, preparing for Trials; negotiating settlements with insurance adjusters or Plaintiff/Defendant’s counsel; train law students and law clerks; conduct insurance, corporate and bankruptcy searches; maintain tickler system in order to ensure that all claims are filed prior to limitation date; and where necessary, obtain and instruct agents to attend Pretrial/Trials on behalf of Hydro One.
  • Assist solicitors in other legal proceedings by investigating, interviewing and organizing witnesses, organizing documentation, preparing standard court forms, process serving court documents, etc, in accordance with specific instructions or established procedures.
  • Visit courts and other government offices for filing cases, carrying out searches and processing uncontested legal proceedings or supervising agents or students.
  • Conduct Pretrial by personal attendance or by way of telephone conference to process or defend claims and attempt resolution of claims.
  • Assist Labour/Employment Counsel with the preparation of arbitrations and submissions for Labour Relations Board hearings or dealing with other employment law related matters.
  • Assist in the preparation of confidential labour/employment related matters, as required.
  • Provide various claims analysis and assessment of liability and damages.
  • Submit findings to the appropriate counsel for review and further action.
