About The Position

Hard Rock International (HRI) is seeking an individual with law firm or in-house corporate experience to work at its corporate headquarters in Davie, Florida. This position reports to the in-house IP attorney and will assist with trademark preparation and prosecution (domestic and international), product development, clearance, marketing and advertising review, brand protection, and enforcement work. The preferred candidate will support and manage HRI’s IP portfolio and corporate and transactional work.

Requirements

  • Paralegal Certificate preferred; Bachelor's Degree strongly preferred.
  • Minimum of 5 years Intellectual Property experience focused on US and international trademark prosecution and overall comprehensive knowledge of the intellectual property practice area.
  • Familiarity with electronic filing with the USPTO, WIPO and other foreign entities.
  • Strong knowledge of U.S. trademark prosecution procedures and TMO rules and forms, required.
  • Thorough understanding of docketing policies and procedures as they relate to the USPTO including TEAS, TSDR, TTAB and foreign requirements.
  • Strong verbal and written communication skills, as well as excellent proofreading skills.
  • Highly organized and demonstrated ability to work effectively in a fast-paced setting involving multiple projects, competing timelines and timely respond to deadlines, balance workload and take initiative.
  • Must be able to perform and work independently as well as part of a small team.

Nice To Haves

  • Familiarity with electronic document management systems, WebTMS and T360 a plus.

Responsibilities

  • Prepare and file trademark applications, via USPTO, the Madrid Protocol and foreign associates, with follow through to registration.
  • Prepare and file maintenance documents to include statements of use, extension of time, petition to divide, renewal applications, declaration of incontestability, excusable nonuse declaration, response to office actions and other related filings.
  • Manage attorney dockets to ensure all deadlines are met in a timely manner.
  • Review files and confer with in-house attorney to discuss file status and upcoming deadlines.
  • Perform trademark searches and assist on due diligence reviews.
  • Review and analyze trademark watch notices and report to the in-house attorney and internal clients.
  • Draft correspondence and maintain foreign associates and vendor files and contact information.
  • Review marketing and promotional materials for proper usage of trademarks and other IP, and to determine IP clearance needs.
  • Assist in-house attorney with responding to consumer complaints or litigation related to IP matters, marketing initiatives, including conducting investigations and providing other assistance as necessary
  • Draft basic terms for promotional offers.
  • Assist with maintaining knowledge resources and implementing process improvements related to legal review of product development, trademarks, marketing promotions and activations.
  • Work with Hard Rock teams to develop training materials, resources and presentations for the IP area, marketing, and branding teams on relevant topics.
  • Perform other general corporate legal duties and functions as may be assigned or required by business needs.
  • Prepare and submit copyright filings in the US and overseas.
  • Provide backup support/coverage to other paralegals, as required.
