About The Position

Hearing Officer position available in the Agency for Health Care Administration Office of the General Counsel, Fair Hearing Section. The position is full-time, requires a five-day work week (Monday through Friday), and is located in one of the following locations: Clearwater, Orlando, Tallahassee, Tampa, Florida. The position works under the supervision of the Fair Hearing Section Chief or designee. This position will be filled at $40.00 Hourly and is non-negotiable.

Requirements

  • Admission to the Florida Bar with membership in good standing
  • Two (2) years of professional experience in the practice of law, legal research and writing, judicial and legal clerk or internships, teaching law or in administrative judicial hearings.
  • Demonstrated legal research and writing skills
  • Knowledge of the Medicaid program
  • Knowledge of civil and/or administrative litigation procedures
  • Familiarity with administrative rulemaking
  • Computer skills
  • Strong oral and written communication
  • Organizational abilities
  • Effective time management
  • Ability to work either independently or collaboratively, as required
  • Florida Bar licensure

Nice To Haves

  • Knowledge of the Medicaid program
  • Administrative and/or civil litigation experience

Responsibilities

  • Conduct fair hearings for Medicaid programs administered by the Agency for Health Care Administration under the authority of section 409.285, Florida Statutes and 42 C.F.R. §431, Subpart E, & 42 C.F.R. §438, Subpart F.
  • Handle all aspects of assigned Medicaid fair hearing proceedings including case management, conducting the fair hearings and rendering written final orders for the agency, subject to appellate review.
  • Provide legal opinions on assigned topics based on identification of relevant facts, thorough legal research and careful analysis.
  • Identification of potential legal concerns relevant to the operation of the Fair Hearing Section and communication of such concerns to the Fair Hearing Section Chief or designee.
  • Assist in the analysis, implementation and development of legislation relevant to the mission and operation of the Fair Hearing Section.
  • Interpret and apply state administrative rules and federal regulations pertinent to Medicaid fair hearings.
  • Assist in the development of administrative rules necessary for Medicaid fair hearings and the operation of the Fair Hearing Section.
