About The Position

Farm Family is seeking a highly capable Litigation Specialist to join their team. This role is responsible for negotiating lawsuits and directing the activities of defense attorneys, including reviewing litigation strategy and actions for claims involving litigation and/or complex injuries. The position requires advanced technical proficiency in investigation, coverage and exposure evaluation, negotiation, and resolution, contributing to superb client results. This is a 100% in-office position requiring candidates to work on-site during standard business hours.

Requirements

  • A broad theoretical knowledge of managing litigated claims.
  • An exceptional customer service focus.
  • Bachelor’s degree in a related field.
  • A minimum of 2 years’ body injury experience in determining liability, negotiating settlements, reviewing estimates, and medical terminology.
  • Must be able to obtain necessary state licenses and maintain Continuing Education (CE) requirements as needed.
  • Must have good business acumen (i.e., understand how an insurance company works and makes money, including how this role impacts both Argo Group and our customers’ ability to be profitable).
  • Ability to regularly exercise discretion and independent judgment with respect to matters of significance.

  • Proficient in MS Office Suite and other business-related software.

  • Insurance and/or litigation designations such as ACLA, AIC, CCLA, CPCU, FCLA, LPCS, PCLA, SCLA, etc.
  • Juris Doctor from an accredited law school.

Responsibilities

  • Adjudicate less complex claims such as a 2-car accident or minor injury under technical supervision.
  • Provide customer service to clients by delivering superior claims outcomes and building connections with insureds and brokers.
  • Analyze claims forms, policies, endorsements, client instructions, and other records to determine policy coverage for claims.
  • Coordinate a litigation plan with defense counsel that balances cost-effective defense with the insured's best interests.
  • Conduct in-depth investigations and reviews, including interviewing parties, to properly evaluate and assess exposure.
  • Review relevant venue-specific case law.
  • Complete case evaluations and ensure proper reserves are placed on exposures according to the company's reserving philosophy.
  • Handle multi-line litigation claims for all lines of business (personal and commercial), including property, liability, and first/third-party exposures.
  • Make daily decisions on the appropriate course of action for files, considering insured's exposure, company exposure, and cost factors.
  • Attend depositions, court-ordered mediations, trials, arbitrations, and settlement meetings, which may involve overnight travel.
  • Negotiate in a timely and effective manner to provide cost-effective solutions within own limits using various negotiation styles.
  • Consider Alternative Dispute Resolutions and utilize creative resolutions when appropriate.
  • Manage diaries and complete tasks to ensure cases achieve the best financial outcome and timely resolution.
  • Review legal expenses incurred in the defense of litigation.
  • Report to the Claims Committee when appropriate.
  • Evaluate claims for bodily injury, review medical reports/records/bills, and calculate past/future medical expenses and wage loss.
  • Analyze the value of Personal Injury Claims for compensation, considering past and future values.
  • Confirm and/or perform permanency ratings according to AMA guidelines to assess exposure and claim value.
  • Recognize, investigate, and handle recoveries from subrogation, salvage, liens, loss transfers, or other related claim areas.
  • Handle all correspondence relating to litigation files and respond accordingly.
  • Communicate and maintain professional relationships with insureds, claimants, agents, attorneys, vendors, and management regarding claim status.
  • Demonstrate an appreciation and passion for strong claim management.
  • Use listening and questioning techniques to effectively gather information from insureds and claimants.
  • Present information clearly, concisely, and accurately.
  • Demonstrate a desire for continued professional development through continuing education and self-development opportunities.
