About The Position

The Utah Labor Commission is seeking a team player with excellent communication and legal writing skills to fill an Employment and Housing Discrimination Investigator position with the Utah Antidiscrimination and Labor Division (UALD). This is a hybrid position offering in-person and telework opportunities for State of Utah residents. Full-time in-office training is required prior to remote opportunities being available. In order to work from home, the successful candidate will need to have WIFI access in their home and complete all work within the state of Utah. As a neutral fact-finder, you will gather facts related to claims of employment and housing discrimination and of unpaid wages and use your legal analysis skills to draft orders determining whether there was a violation of the law. This position requires that you make findings of fact, have a thorough understanding of the relevant law, strong legal writing skills, and a knowledge of analyzing the relevant law to the facts and drawing a conclusion based on your legal analysis. You will need to complete each case with a written determination or administrative order that includes findings of facts, analysis, and conclusions of law.

Requirements

  • A Juris Doctor (JD) or equivalent training and experience.
  • Proficiency in Microsoft Word and/or Google Docs.
  • Must successfully pass a criminal history check.

Nice To Haves

  • Prior experience applying the law to a specific set of facts.
  • Experience with fair housing, employment discrimination (EEO), or wage laws.
  • Prior legal or investigative experience including: Collecting, reviewing, and analyzing evidence. Interviewing witnesses or parties. Performing legal research. Conducting legal analysis including applying a set of facts to the law and drawing a conclusion. Managing a caseload and meeting deadlines. Drafting decisions, motions, memoranda, or legal orders.

Responsibilities

  • Reviewing complaints of employment and housing discrimination and harassment, denial of reasonable accommodation, and unlawful retaliatory actions to determine whether a violation of the law occurred.
  • Acting as a Hearing Officer and issuing orders on claims of unpaid wages.
  • Interviewing relevant parties and witnesses.
  • Reviewing evidence and statements submitted by the parties.
  • Drafting legal determinations and orders related to the investigation.
  • Conducting legal research.
  • Drafting documents consisting of concise legal decisions based upon facts, interpretations of law, and compliance with state and federal standards.
  • Receiving, researching, and responding to incoming questions or complaints.
  • Delivering presentations or instruction to staff, management, or the general public.
