About The Position

Bitdeer is seeking a senior litigator to lead litigation strategy for its U.S. Legal team in San Jose, California. The role oversees disputes involving the company’s data center and power infrastructure, including commercial, construction, energy-contract, insurance, securities, employment, bankruptcy, land-use, and regulatory matters. As a function leadership role, the Director will determine litigation strategy, counsel selection and terms, evidence preservation, and how exposure is communicated to management, Finance, and auditors. The role reports to the General Counsel, North America, and works alongside experienced litigation counsel without displacing their ownership of matters. The Director will manage the North America disputes docket from intake through resolution, lead high-exposure matters, build and oversee the outside counsel panel, and establish standards for matter management, budgeting, reporting, escalation, and settlement authority. The role also manages litigation holds and preservation, provides exposure and loss-contingency analysis for Finance, auditors, and public-company disclosures, and presents litigation risks to senior management and, when requested, the Board or Audit Committee. Additional responsibilities include negotiating resolutions, responding to subpoenas and government requests, overseeing investigations, managing insurance claims and coverage disputes, and partnering with business teams to identify and reduce dispute risks. The Director may also support other legal matters as assigned. Bitdeer describes its culture as inclusive, respectful, and energetic, with opportunities to contribute to projects and processes in a fast-growing digital asset and AI computing company. The position involves working with colleagues across Asia and North America, including some meetings outside U.S. business hours, and travel to project sites, courts, and hearings as needed.

  • J.D. from an ABA-accredited law school.
  • Active bar membership in good standing.
  • At least 12 years of complex commercial litigation experience at a leading law firm and/or as in-house litigation counsel.
  • Experience as the senior-most litigation lawyer in a function, a practice group leader, or lead partner on a portfolio of matters for a major client.
  • Record of owning matters end to end in state and federal court and arbitration, including dispositive motion practice, discovery and expert work, and first- or second-chair trial or arbitration hearing experience.
  • Demonstrated ownership of outside counsel economics, including panel selection, rate and fee negotiation, budget discipline, and recognizing overstaffing.
  • Experience advising executives and boards on exposure, reserves, and resolution.
  • Experience building litigation infrastructure, including preservation programs, matter intake, reporting, and authority thresholds.
  • Judgment to establish standards and influence colleagues without relying on reporting lines, and willingness to remain hands-on.
  • Excellent writing and oral advocacy skills.
  • High self-motivation and a collaborative style suited to a fast-growing, global company.
  • Ability to work with colleagues across Asia and North America, including some meetings outside U.S. business hours.
  • Ability to travel to project sites, courts, and hearings as needed.

  • Experience with securities litigation, insurance coverage disputes, bankruptcy and creditor disputes, employment litigation, or land-use and zoning matters.
  • Internal investigations or regulatory experience, including responding to government inquiries.

Responsibilities

  • Manage the North America disputes docket end to end, including matter allocation, strategy, outcomes, timelines, and spend across litigation, arbitration, pre-suit disputes, and adversarial regulatory proceedings.
  • Lead high-exposure matters, including disputes affecting major sites and projects, securities and shareholder matters, and matters with public-company disclosure consequences.
  • Select and manage outside counsel, negotiate rates and alternative fee arrangements, establish staffing and budget expectations, and report spend and performance by matter and firm.
  • Manage the litigation hold and preservation program, including issuance and scope, custodian tracking, eDiscovery vendor management, privilege and production oversight, and business-team training.
  • Establish standards for matter intake and early case assessment, case management and budgeting, status reporting, and escalation and settlement authority thresholds.

  • Recommend settlement positions based on litigation risk, cost to continue, and commercial consequences, and negotiate resolutions directly when appropriate.
  • Lead responses to subpoenas, regulatory inquiries, and government information requests; conduct or oversee internal investigations.
  • Set strategy on significant matters, review key work product, and develop the practice of experienced litigation counsel on the team without displacing their matter ownership.
  • Partner with project, construction, energy, procurement, HR, and finance teams to identify dispute risk early, improve contract terms and operating practices, and reduce disputes over time.
