About The Position

This position is for a Deputy Prosecuting Attorney (DPA) with multiple levels: I, II, or III. The DPA I represents the State in district court matters, including gross misdemeanors, misdemeanors, probation violations, and traffic infractions. The DPA II represents the State in felony criminal cases and juvenile matters, or provides civil representation for the County, handling more complex cases than DPA I with moderate supervision. A minimum of three years of law practice experience is required for DPA II. The DPA III also represents the State in felony criminal cases and juvenile matters, or provides civil representation for the County, but requires significant Juvenile and/or Superior Court jury trial and/or courtroom experience, handles the most complex and serious cases with minimal supervision, and may have lead or informal supervisory responsibilities.

Requirements

Graduation from a recognized and accredited school of law or completion of the Rule 9 Law Clerk Program and admission to the Bar of the State of Washington.
Ability to perform legal research.
Ability to analyze and apply legal principles, facts, evidence, and precedents to legal problems.
Ability to present law, facts, evidence, and arguments clearly and logically in written and oral form.
Ability to work harmoniously with law enforcement and court personnel and maintain good public relations.
Minimum of three years of practice as an attorney (for DPA II).
Minimum of seven years of practice as an attorney (for DPA III).
Significant Juvenile and/or Superior Court jury trial and/or courtroom experience (for DPA III).
Valid state driver's license in state of residence.
Member in good standing of the State Bar of Washington.

Responsibilities

Represents the State in district court cases, including researching legal bases, reviewing evidence, interviewing witnesses, evaluating cases, preparing charges, negotiating plea agreements, and appearing in hearings and jury trials.
Drafts legal pleadings such as information and/or criminal complaints, jury instructions, trial briefs, motions in limine, and probable cause statements.
Consults with law enforcement regarding investigations and advises on legal issues related to criminal cases.
Maintains current knowledge of substantive, procedural, and evidentiary laws of the State of Washington, federal constitutional law, and court procedures.
Fills in for other prosecutors as needed.
Represents the Department of Corrections in revocation proceedings or other legal hearings for violations of felony supervision or placement.
Reviews notice of violation reports and prepares documents to request arrest warrants.
Issues subpoenas and presents the State’s case at hearings.
Drafts orders for Superior Court for disposition of violators.
Represents the County in the defense and resolution of civil law cases and issues, minimizing County’s risk and liability, and litigating and negotiating civil cases and contracts.
Confers with, and offers advice and counsel to County officials and employees, applying legal expertise in various civil law fields.
Performs legal research and prepares written and oral opinions on legal problems or issues.
Reviews and processes requests for County records, drafts of contracts and resolutions, requests for payment, and drafts county codes.
Represents the interests of the State in certain child support and paternity cases.
Represents the interests of the County in state and federal administrative hearings and claims.
May participate in community outreach and educational programs.
Performs other related duties as assigned.
