About The Position

The Delaware Department of Justice is seeking a highly motivated and experienced litigator to serve as a Deputy Attorney General in the Office of Impact Litigation, part of the Fraud & Consumer Protection Division. This is a significant opportunity to do complex and high-impact legal work in areas of immediate local and national importance. This position reports directly to the Director of the Office of Impact Litigation and will represent the Attorney General and the State in a broad range of impact litigation and investigative matters aligned with the Attorney General’s policy priorities. You will pursue affirmative litigation across a wide range of subject areas, collaborate with multistate partners, and contribute to the development of amicus briefs, rulemaking comments, and other advocacy efforts that shape law and policy at the state and national level. Areas of focus may include federal accountability, federal rulemaking, constitutional rights, environmental protection, firearms safety, healthcare, immigration, labor protections, and the oversight of Delaware’s charitable entities. This position may be eligible for telework for up to three days per week.

Requirements

  • A minimum of four years of legal practice experience
  • Solid understanding of complex civil litigation
  • At least ten years of experience handling complex litigation in both federal and state courts
  • Excellent writing and oral advocacy skills
  • Strong commitment to public service and advancing the public interest
  • Admission to the Delaware Bar, or a willingness to sit for the next Delaware Bar examination

Responsibilities

  • Handle affirmative litigation and investigations in support of the Attorney General’s policy objectives, including multistate and in-state matters involving federal accountability, constitutional rights, environmental protection, firearms safety, healthcare, immigration, employee labor protections, and oversight of Delaware’s charitable entities.
  • Lead or support investigations that could lead to future impact litigation efforts.
  • Assist with the development and review of amicus briefs, rulemaking comments, and position letters on non-criminal matters.
  • Work closely with other Deputy Attorneys General and a Paralegal to track incoming materials, conduct legal research, and prepare recommendations for the Attorney General’s consideration.
  • Draft original briefs, comments, or letters to reflect and implement the Attorney General’s policy goals.
  • Perform work related to the Attorney General’s charter revocation authority, requiring coordination with the federal Office of Foreign Asset Control (OFAC) and the Delaware Division of Corporations.
  • Other duties as assigned by the Director of the Office of Impact Litigation.
