The role involves significant appellate advocacy, engaging with complex legal issues, and contributing to legal developments. Appellate Counsel are responsible for advancing and responding to appeals before the Court of Appeal and the Supreme Court of Canada, providing legal advice within ACPS, and contributing to Crown education programs. The incumbent must handle serious and complex appeals, possess comprehensive knowledge of substantive and procedural law, and advise senior management, other prosecutors, enforcement agencies, and other government departments on criminal law matters. The Appeals Unit's mission is to serve the public and the interests of justice through excellence in prosecutions, aiming to continually improve the conduct of criminal prosecutions at trial and on appeal. Their core business includes conducting all criminal appeals, coordinating and advising on constitutional challenges to federal criminal legislation, and handling complaints of wrongful convictions or miscarriages of justice.
