About The Position

The Alberta Crown Prosecution Service (ACPS) prosecutes individuals charged with offenses under the Criminal Code, Youth Criminal Justice Act, and provincial statutes. The ACPS contributes to community safety by prosecuting serious and violent crimes and collaborating with community partners to improve criminal justice administration. This specific role is within the Appeals Unit, seeking a lawyer for a temporary, two-year position in Edmonton. The role involves significant appellate advocacy, engaging with complex legal issues, and contributing to legal developments. Appellate Counsel are responsible for advancing and responding to appeals before the Court of Appeal and the Supreme Court of Canada, providing legal advice within ACPS, and contributing to Crown education programs. The incumbent must handle serious and complex appeals, possess comprehensive knowledge of substantive and procedural law, and advise senior management, other prosecutors, enforcement agencies, and other government departments on criminal law matters. The Appeals Unit's mission is to serve the public and the interests of justice through excellence in prosecutions, aiming to continually improve the conduct of criminal prosecutions at trial and on appeal. Their core business includes conducting all criminal appeals, coordinating and advising on constitutional challenges to federal criminal legislation, and handling complaints of wrongful convictions or miscarriages of justice.

Requirements

  • A Bachelor of Laws (LLB) or Juris Doctor (JD).
  • Active membership or immediate eligibility for membership with the Law Society of Alberta.
  • Prosecution experience with criminal law.
  • For Law degrees obtained outside Canada, proof of accreditation from the National Committee on Accreditation (NCA) is required.
  • A valid Alberta Motor Vehicle Operators License.
  • Travel within the province is required.
  • Drafting legal opinions/briefings and court documents professionally and appropriately.
  • Working effectively to build collaborative environments with stakeholders of the justice system.
  • Problem solving and adapting approach as required to achieve intended outcomes.
  • Independent decision making.
  • Prioritizing actions/cases effectively to respond to numerous challenges and demands.
  • Analyzing situations fully to make informed decisions.

Responsibilities

  • Advancing and responding to acquittal, conviction, and sentence appeals before the Court of Appeal and the Supreme Court of Canada.
  • Preparation of recommendations with respect to Crown appeals.
  • Providing legal advice within ACPS.
  • Contribution to Crown education programs.
  • Handling very serious and complex appeals.
  • Providing advice to senior management, other prosecutors, enforcement agencies, other branches or divisions of ACPS, and other Alberta Government departments concerning criminal law.
  • Serving the public and the interests of justice through excellence in prosecutions.
  • Continually improving the conduct of criminal prosecutions at trial and on appeal.
  • Conducting all criminal appeals in the Court of Appeal and the Supreme Court of Canada.
  • Coordinating, advising, and assisting in all constitutional challenges to federal criminal legislation.
  • Handling complaints of wrongful convictions or miscarriages of justice.
  • Ensuring the public interest is served and a just result is obtained.
  • Providing the Court with evidence and legal argument that is fair, accurate, and complete.
  • Conducting assigned prosecutions of all serious and complex cases in a highly competent manner.
  • Working with victims of crimes and their families.
