About The Position

The Counsel/Non-Equity Partner must have strong traditional labor law experience to represent management clients in arbitration, grievance proceedings, collective bargaining, mediations, NLRB proceedings, and litigation. The role also includes defending employers in employment litigation in state and federal courts and before administrative agencies, and counseling management clients on compliance with federal, state, and local employment laws.

Requirements

  • Juris Doctor (J.D.) from an accredited law school.
  • Licensed and in good standing to practice law in New York; admission in New Jersey is a plus.
  • 10+ years of traditional labor law experience in a law firm setting.
  • Experience defending employers in employment litigation and before administrative agencies, including the Equal Employment Opportunity Commission and the New York State Division of Human Rights.
  • Experience advising on union organizing campaigns and union elections, and defending unfair labor practice charges before the National Labor Relations Board.
  • Strong knowledge of civil procedure, evidence rules, and experience in both state and federal courts.
  • Excellent legal research, analytical, writing, and problem-solving skills.
  • Proficiency in legal research and case management software.
  • Strong verbal and written communication, public speaking, and presentation skills.
  • Demonstrated ability to manage multiple cases and priorities in a fast-paced environment.
  • Team-oriented with the ability to work independently and collaboratively.
  • Exceptional attention to detail and organizational skills.
  • Ability to work well under pressure and meet deadlines.

Responsibilities

  • Regularly represent management clients in arbitration, grievance proceedings, collective bargaining, mediation, litigation in state and federal court and before local, state and federal agencies, including the National Labor Relations Board, the Equal Employment Opportunity Commission, and the New York State Division of Human Rights.
  • Advise clients on union organizing drives and union elections and respond to unfair labor practice charges.
  • Defend employers in employment litigation, including discrimination, harassment, retaliation, wrongful termination, and wage and hour claims, including class and collective actions.
  • Daily consultation with clients on the administration of collective bargaining agreements as well as compliance with local, state, and federal laws and HR-related matters, including the Fair Labor Standards Act, Title VII of the Civil Rights Act, the Family and Medical Leave Act, the New York Labor Law, and the New York State and New York City Human Rights Laws.
  • Conduct workplace investigations of employee complaints and draft and revise employee handbooks for compliance with applicable laws.
  • Assist in negotiation and drafting of collective bargaining agreements, employment agreements, non-disclosure, non-compete and non-solicitation agreements, settlement and separation agreements, bulletins and memoranda.
  • Advise clients regarding non-compete and non-solicitation agreements and litigate to enforce these agreements, including in temporary restraining order and injunction proceedings.
  • Advise clients on reductions in force, including WARN Act compliance, and support corporate transactions with labor and employment due diligence.
  • Conduct training and webinars on labor-management issues, wage and hour compliance, and other areas.
  • Supervise and mentor junior attorneys in the Labor & Employment practice group.
  • Other duties, projects and assignments as required.
