About The Position

The Professional Practice Group (PPG) is a National Office department supporting the Private Trust business. Private Trust delivers three core services: power of attorney, executor and trustee services where The Canada Trust Company is either acting through an appointment to these roles or as an agent. PPG assists in identifying and proactively managing the risk within the personal trust business through policy development/maintenance and assisting the field with the day-to-day discretionary decisions required in the delivery of service. Private Trust is part of TD Wealth one of Canada's largest Wealth Management companies providing a suite of integrated services: investment management, private banking, insurance, estate and trust solutions to high net worth individuals. With an approach based on establishing close-knit, long-term relationships with clients, TD Wealth brings together the expertise and resources of a team of multi-disciplinary experts to provide customized client solutions.

Requirements

  • Experience in an estate and trust environment
  • Experience dealing with matters of a legal nature
  • Strong analytical and critical thinking ability
  • Excellent communication skills, both verbal and written
  • Ability to work as part of a team as well as the confidence to work independently with minimal oversight
  • Ability to critically identify and assess fiduciary risk
  • Comfortable in working with senior management and other external departments e.g. Legal, Compliance
  • Ability to deliver prompt, practical and risk appropriate decisions, recommendations and solutions
  • Strong attention to detail
  • Ability to review legislation and regulation and undertake legal research
  • Self-motivated and resourceful
  • Ability to develop external networking relationships and represent the trust company within the industry

Responsibilities

  • Act as a member of Regional Discretionary Powers Committee
  • Support the field on fiduciary decisions
  • Evolve best practices for making informed, quality decisions
  • Review legal documentation relating to PT files (e.g. settlement agreements, notices of application, draft orders, management plans, affidavits, legal opinions)
  • Review documentation relating to potential new business (e.g. escrow agreements, Indigenous Trust Services deeds, blind trust deeds)
  • Review service agreements, fee schedules, and internal forms/letters/checklists
  • Maintain relationships with Compliance, Legal, Governance and Control
  • Internal regulatory licensing requirements, as needed (e.g. notarial signing)
  • Assist with monthly Business Risk Meeting with control partners
  • Prepare and communicate regular reporting requirements to key stakeholders
  • Stay abreast of legislative changes and industry practices impacting the business through industry blogs and bulletins, continuing legal education webinars and via Legal and Compliance
  • Review and ongoing updating of policies according to schedule
  • Work with Governance & Control and other required parties for approval of policy changes
  • Record retention policy
  • Handle ad hoc requests as they arise
