This position is responsible for conducting investigations of potential violations of the FAMLI Act. This position ensures that investigations follow the approved process, are lawfully and objectively conducted, are thorough in gathering all material facts and present an accurate accounting of the issues. This position requires analyzing complaints, planning and conducting investigations (including such activities as determining what evidence is needed and gathering it, locating and interviewing witnesses and subjects, verifying the authenticity of documents, examining financial books and records), and assessing the severity of the violation. As a result of the investigation, this position is responsible for writing investigation and determination reports of findings, creating exhibits for hearings, serving as a witness for the Division, and ordering administrative sanctions, including fines and penalties, with justifications for those recommended actions. The investigator’s determinations are subject to review through the Division’s appeals process and Colorado court system. This position determines individual case priority, and timeframes for completion of individual investigations. This position uses sound judgment and resourcefulness to interpret circumstances and establish guidelines that direct the individual investigations. This position may require additional help from more experienced Compliance Investigators II to provide specialized knowledge regarding investigations or decisions on how to proceed in investigations. This position also provides education to claimants and their representatives, businesses and other private and public/governmental entities within the State of Colorado.
