About The Position

The Commercial Manager, reporting to the Senior Director, Industrial, will be responsible for the successful administration of contracts with clients, consultants, subcontractors, and suppliers. This role supports multiple concurrent industrial projects and is based in Mississauga, ON. The Commercial Manager will work within a multi-disciplined team on fast-paced, high-value construction projects, ensuring alignment between the client, our team, and our subcontractors regarding contractual obligations. This role involves highlighting risks for the Project Management Team, participating in the development of a risk register, and reviewing the Prime Contract to determine obligations, liabilities, and risks. The Commercial Manager will manage contract administration processes and results, provide interpretation of Prime Contract language, and develop contract management activities to ensure compliance. Responsibilities include managing contract reporting activities, identifying and tracking deliverables, and mitigating/preventing/resolving problems with high risk or monetary cost to Bird. The role involves developing correspondence with the Client for changes and modifications, assisting the project management team with contractual items such as change orders, documenting variations, and negotiating changes. It also includes bid analysis for subcontractors and suppliers, negotiating subcontracts and lower-tier agreements, and managing subcontractors and suppliers, including resolving contractual issues and reviewing change entitlement. The Commercial Manager will ensure timely and accurate contractual correspondence, develop and implement Change Management procedures, track contract and subcontract changes/modifications, and prepare narratives and entitlement documentation. Claims avoidance and management, including forensic analysis of cost and schedule impacts, are also key responsibilities. Maintaining excellent relationships with clients, subcontractors, suppliers, and the public is crucial. The role involves training project teams on contract processes and procedures, liaising with project teams, and providing updates to District Management and Risk Management groups. Developing and implementing District and Company-wide best processes and policies, conducting monthly reviews of potential claims and opportunities, and reviewing/actioning surety and insurance requirements are also part of the role. Additionally, the Commercial Manager will support project pursuit teams and estimating, and develop tender and RFP qualifications.

Requirements

  • Post-secondary education, such as a degree or diploma in a related field, and/or relevant combination of experience.
  • 10+ years’ leadership experience in the construction industry.
  • A strong background in project or contract management.
  • Ability to use MS Word, Excel, Outlook, MS Project and Primavera P6.
  • Excellent financial and numeracy management skills.
  • Working knowledge of contract language and legal requirements of contracts.
  • Ability to inspire trust in difficult situations by instilling confidence and engaging people on matters that affect them.
  • Ability to forge, grow and maintain positive relationships.

Responsibilities

  • Successful administration of contracts with clients, consultants, subcontractors and suppliers.
  • Support multiple concurrent industrial projects.

  • Bid analysis for subcontractors and suppliers.
  • Negotiating subcontracts and other lower tier agreements.
  • Subcontractor and Supplier management, including resolving contractual issues, administration, reviewing change entitlement, and other duties required to support the successful administration of subcontracts and other lower tier agreements.
  • Ensure timely and accurate contractual correspondence.
  • Develop and implement Change Management procedures and track contract and subcontract changes/modifications.
  • Prepare narratives and entitlement documentation.
  • Claims avoidance and management, including forensic analysis of cost and schedule impacts for preparation of claims submissions.
  • Maintain excellent relationships with clients, subcontractors, suppliers and the public.
  • Train project teams on the implementation of contract processes and procedures and contractual requirements/obligations.
  • Liaise with project teams on a variety of matters as required and provide key updates to the District Management and Risk Management groups as necessary when issues arise.
  • Develop and implement District and Company-wide best processes and policies.
  • Conduct monthly review and communication of potential claims and opportunities with Industrial West Management Team.
  • Review and action all surety and insurance requirements for the project and ensure compliance with surety provided for subcontracts.
  • Support project pursuit teams and estimating, and develop tender and RFP qualifications.
