The Commercial Expert – Mexico will provide senior-level commercial, contractual, and financial oversight for all WIFA project components in Mexico or with cross-border commercial interfaces. This role ensures that all contracts (construction, engineering, procurement, service) are structured, negotiated, administered, and managed in alignment with WIFA commercial objectives, contract requirements, ACCIONA risk standards, and Mexican regulations. The position is crucial for supporting early engagement, assessments, decision-making, bid development, early works, feasibility, and construction delivery by identifying and actively managing commercial risks throughout the project lifecycle. The Commercial Expert will collaborate closely with the Project Director, Program Manager, Construction Lead – Mexico, Technical Experts, Finance, and Legal teams to protect project value, manage claims, and ensure contract compliance for all Mexico-based scopes.

Requirements

  • Bachelor’s degree in Business, Engineering, Construction Management, Finance, Law, or related discipline.
  • Proven experience in commercial or contract management on large infrastructure or industrial projects.
  • Demonstrated experience managing construction and engineering contracts in Mexico.
  • Strong contract, financial, and risk management skills.
  • Excellent negotiation and commercial judgment.
  • Ability to work effectively with technical, construction, legal, and finance teams.
  • High attention to detail with a proactive, problem-solving mindset.

Nice To Haves

  • Advanced degree or professional certifications (MBA, commercial management, contract law) preferred.
  • Water infrastructure experience preferred.

Responsibilities

  • Lead commercial strategy development for Mexico-based scopes, including construction, EPC, subcontracting, and vendor agreements.
  • Support development of commercial models, scope allocations, and risk-reward structures during feasibility and early works.
  • Ensure alignment of Mexican contracts with overall WIFA program commercial strategy and cross-border agreements.
  • Support or lead development and negotiation of contracts, amendments, and change orders with contractors, subcontractors, and suppliers in Mexico.
  • Oversee contract approach for administration activities, ensuring compliance with commercial terms, payment provisions, bonding, and guarantees.
  • Monitor contractual obligations, deliverables, and milestones across Mexican work packages.
  • Work with project controls and finance teams to develop budgets, track costs, commitments, forecasts, and earned value for Mexico-based scopes.
  • Review and validate contractor payment applications, variations, and commercial claims.
  • Support budget control, cash-flow monitoring, and financial reporting inputs related to Mexican activities.
  • Identify, assess, and manage commercial risks, claims, and disputes arising from construction and service contracts.
  • Support preparation and negotiation of variation orders, extensions of time, and claims mitigation strategies.
  • Coordinate with Legal and Project Leadership on dispute resolution strategies, as required.
  • Ensure contracts comply with applicable Mexican commercial, labor, tax, and regulatory requirements, while maintaining alignment with U.S.-side WIFA contractual frameworks.
  • Support coordination between U.S. and Mexico teams on commercial interfaces, currency exposure, and cross-border payment mechanisms.
  • Prepare commercial inputs for governance reviews, investment committees, and client reporting.
  • Support presentations and commercial briefings for WIFA stakeholders and internal ACCIONA leadership.
  • Contribute to continuous improvement of commercial processes and lessons learned for future WIFA phases.
