The Town of Fort Myers Beach is seeking Code Compliance Officers (Level I or Level II) to support the enforcement of the Town's Land Development Code, local ordinances, zoning requirements, and nuisance regulations that protect public health, safety, welfare, and neighborhood standards. Position Summary The Code Compliance Officer performs specialized investigative, enforcement, compliance, and public service work related to the enforcement of the Town's Land Development Code, local ordinances, zoning requirements, public nuisance regulations, and related municipal codes. The position is responsible for conducting inspections, investigating complaints, documenting violations, preparing enforcement cases, and coordinating compliance efforts to help protect the public health, safety, welfare, and appearance of the community. This position requires significant fieldwork, independent judgment, customer service, conflict resolution, and coordination with Town departments, contractors, residents, businesses, public agencies, and legal representatives. The position promotes voluntary compliance through education, communication, and professional interaction with the public while supporting the Town's operational and community standards. Level of supervision is dependent upon experience, demonstrated competency, and certification level: entry/junior staff perform work under closer supervision with more prescribed procedures and review, while more advanced officers exercise greater independent judgment, handle more complex investigations, and support division-level consistency, coordination, and mentoring. The position also supports emergency preparedness, response, recovery, post-disaster operations, damage assessment activities, and continuity of operations efforts during emergency activations and disaster events. Responsibilities and Reporting During an Emergency Situation If assigned, employees in this classification will be required to report and carry out duties as directed for the duration of an emergency. Depending on the nature of the emergency, this may require working extended hours, including around the clock for several days on short notice. Code Compliance Officer I (Entry / Foundational) This is an entry-level classification that performs assigned inspections, investigations, documentation, follow-up, and public education duties related to code violations and ordinance enforcement while learning Town procedures and standards. Positions assigned to this classification work under the direction of the Code Compliance Manager with closer supervision and regular review. Code Compliance Officer II (Advanced / Senior Technical) This is an advanced classification that performs complex and specialized investigations and enforcement activities with greater independence and discretion. Positions assigned to this classification may serve as a resource to other officers, assist with outreach/education, and support division coordination and consistency.

Requirements

  • High school diploma or GED required.
  • Minimum of one (1) year experience in code compliance, code enforcement, investigations, zoning enforcement, building inspections, public safety, regulatory compliance, municipal operations, or a related field preferred.
  • State of Florida Driver's License required.
  • Certification by the Florida Association of Code Enforcement (FACE) Fundamentals of Code Enforcement required or must be obtained within twelve (12) months of employment.
  • All required education and certifications must be maintained current and valid.
  • Government or municipal experience preferred.
  • AA/AS degree in related field required or required combination of training and experience preferred.
  • Minimum of three (3) years of experience in code compliance, code enforcement, investigations, zoning enforcement, building inspections, public safety, regulatory compliance, municipal operations, or a related field required.
  • Certification by the Florida Association of Code Enforcement (FACE) in one or more of the following: Legal Issues in Code Enforcement, Administrative Aspects in Code Enforcement, and Officer Safety Field Applications.
  • Certification by the International Code Council as a Property Maintenance and Housing Inspector. (Can be substituted for all FACE certifications except Fundamentals of Code Enforcement)
  • Knowledge of municipal codes, ordinances, zoning regulations, land development regulations, nuisance abatement procedures, and applicable state and local laws related to code compliance and enforcement.
  • Working knowledge of Florida Statutes Chapter 162 and related enforcement procedures.
  • Knowledge of investigative methods, inspection techniques, evidence collection, documentation practices, and enforcement procedures.
  • Knowledge of customer service principles, conflict resolution techniques, and professional public interaction practices.
  • Knowledge of modern office technology, permitting systems, enforcement software, mobile technology, and digital records management systems.
  • Ability to interpret and apply municipal codes, ordinances, regulations, policies, and procedures consistently and fairly.
  • Ability to conduct inspections, investigations, research, and enforcement activities with professionalism and sound judgment.
  • Ability to communicate effectively both verbally and in writing with residents, contractors, businesses, Town staff, legal representatives, and the public.
  • Ability to prepare accurate reports, notices, affidavits, case files, enforcement documentation, and related records.

Responsibilities

  • Performs investigative, enforcement, compliance, follow-up, and public education duties related to code violations, zoning regulations, nuisance complaints, public safety concerns, and local ordinance enforcement.
  • Conducts field inspections, job site visits, and property investigations to verify compliance with Town codes, ordinances, permits, land development regulations, and applicable laws.
  • Investigates complaints regarding zoning violations, rights-of-way, abandoned or inoperable vehicles, signage, overgrowth, sanitation concerns, unsafe conditions, unlicensed activity, and other code-related matters.
  • Gathers, reviews, interprets, documents, and maintains photographs, witness statements, inspection reports, evidence, case files, and related documentation associated with investigations and enforcement activities.
  • Issues notices, warnings, citations, stop work orders, notices of violation, notices to appear, and related enforcement documentation as authorized and warranted
  • Conducts follow-up inspections to verify compliance and closure of violations and coordinates corrective action efforts as necessary.
  • Monitors compliance with zoning requirements, Certificates of Use, Business Tax Receipts, signage regulations, and related land use requirements.
  • Investigates potential hazards to public health, safety, and welfare and coordinates with applicable departments and agencies regarding corrective measures and enforcement actions.
  • Coordinates towing of abandoned, illegally parked, or inoperable vehicles in accordance with applicable laws, ordinances, and Town procedures.
  • Manages or assists with vacant property registration and monitoring programs as assigned.
  • Assists with contractor licensing compliance investigations and enforcement activities related to unlicensed or unpermitted work.
  • Promotes voluntary compliance through education, communication, and professional interaction with residents, businesses, contractors, visitors, and property owners.
  • Utilizes conflict resolution and de-escalation techniques during difficult or confrontational interactions while maintaining professionalism and composure.
  • Responds to citizen complaints, inquiries, and concerns both orally and in writing and provides information regarding code compliance procedures and regulations.
  • Meets with residents, contractors, businesses, community groups, Town staff, and property owners regarding code compliance matters, enforcement procedures, and operational concerns.
  • Attends community meetings, public hearings, seminars, and related meetings as assigned.
  • Performs research and investigative work necessary to determine the extent of violations and prepare enforcement cases for legal or quasi-judicial proceedings.
  • Prepares reports, affidavits, case summaries, notices, citations, enforcement documentation, and related records in support of compliance and enforcement activities.
  • Attends Special Magistrate hearings, Code Enforcement Board hearings, court proceedings, and related meetings as directed and may provide testimony regarding enforcement cases.
  • Coordinates with the Town Attorney, Planning Division, Building Division, Public Works, Emergency Services, law enforcement agencies, and outside governmental agencies regarding compliance matters and enforcement activities.
  • Assists municipal, state, and federal agencies with investigations, code-related matters, emergency operations, and compliance activities as appropriate.
  • Utilizes permitting systems, enforcement software, mobile technology, databases, digital records systems, and related applications to document inspections, violations, enforcement actions, photographs, operational activities, and case management functions.
  • Maintains accurate records, reports, inspection logs, photographs, enforcement documentation, and operational files related to assigned duties and activities.
  • Assists with hurricane preparedness, emergency response, disaster recovery, damage assessment, debris management coordination, restricted access enforcement, post-disaster compliance activities, and other emergency management functions as assigned.
  • Performs emergency response assignments and operational support duties during emergency activations and disaster events.
  • Supports continuity of operations and emergency operational coordination efforts as directed.
  • Attends assigned meetings, training sessions, and events.
  • Maintains regular and punctual attendance.
  • Performs other duties as assigned.
  • Works on specialized duties and projects assigned. IE: Short-term rentals, expired building permits, work conducted without permits, lack of required zoning approvals and/or violation of zoning approvals, temporary permit inspections, and other similar duties.
  • Provides direction and staff supervision concerning community outreach and education on various topics.
  • Works in conjunction with other senior staff to ensure consistency of information, communication, policy adherence, and optimal performance.
  • Assists the Code Manager in advising other Code Officers concerning standard operating procedures, code interpretations, investigations, field operations, enforcement procedures, public records requests, case and lien processing, contractor regulations, presentations of cases to regulating boards and special magistrates.
  • Assist the Code Manager in the investigation and administration of code compliance cases that occur in a timely, effective, efficient, and professional manner.
  • Assists the Code Manager to ensure the preparation of evidence, including the presentation of testimony before the Special Magistrate or other hearing, meeting or board is conducted in a competent and professional manner and also is accordance with established policies and procedures.
  • Composes and presents clear, concise, and fact-based reports on investigative findings, and issues impacting the division.
  • Assists public with information on Building and Zoning related matters; attends public events regarding Code Compliance Division functions.
  • Determines whether there is evidence to support the issuance of notices of violation, civil violation notices, citations, stop work orders, or any other appropriate actions.
  • Acts a backup liaison between Code Compliance and other departments and divisions for the Code Compliance Manager.
  • Conduct community and internal staff outreach, presentations and meetings.
  • Assists the Code Manager with the Code Compliance Abatement Program.
  • Assists the Code Manager with Special Magistrate orders, liens, and foreclosure review, monitoring, and clerk filing.
  • Performs related work as needed.
