About The Position

This National Guard position is for a ATTORNEY-ADVISER (GENERAL) -Title 32, Position Description Number D2665000 and is part of the WI Joint Forces Headquarters - Office of the Staff Judge Advocate, Wisconsin National Guard. A Recruitment Incentive of up to 25% of base salary may be authorized for this advertisement (Note: This incentive is only applicable to employees entering the Federal Technician program). As a ATTORNEY-ADVISER (GENERAL) -Title 32, GS-0905-13, you will serve as the full-time professional legal adviser and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, and state/territory unique public defense or safety structures or wing commander. In this primary purpose, this position also serves as the full-time professional legal advisor and support to Sexual Assault Response Coordinator and State Equal Employment Opportunity advisors, and subordinate commanders to support the state prevention efforts relating to sexual assault, sexual harassment, and domestic abuse. This position also serves as a professional legal adviser to the United States Property and Fiscal Officer (USPFO), state/territory National Guard senior leadership, state/territory National Guard directorates, and subordinate National Guard commanded units or state/territory level divisions. The position is located in the Joint Force Headquarters - State (JFHQ-ST), Office of the Staff Judge Advocate (SJA).

Requirements

Compatible military grade and assignment required prior to the effective date of placement.
Must be eligible for immediate membership in the National Guard.
Military Grades: O2 through O4
Federal employment suitability as determined by a background investigation.
May be required to successfully complete a probationary period.
Must be able to obtain and maintain the appropriate security clearance of the position.
Must be covered by the Domestic Violence Misdemeanor Amendment (30 Sep 96) of the Gun Control Act (Lautenberg Amendment) of 1968.
May occasionally be required to work other than normal duty hours; overtime may be required.
Work may require frequent travel away from the normal duty station on military and commercial aircraft.
The work may require the employee to drive a motor vehicle. An appropriate, valid driver's license may be required for the position.
Must either be currently in good standing (certified) with a State Bar or able to obtain certification.
Must be a graduate of an ABA-accredited law school.
If selected, must become licensed to practice law in the State of Wisconsin within 12 months of hire if not currently licensed to practice law in the State of Wisconsin.
Incumbent is required to submit a Financial Disclosure Statement, OGE-450, (5CFR Part 2634,Subpart I USOGE, 6/08).
Executive Branch Personnel Confidential Financial Disclosure Report upon entering the position and annually, in accordance with DoD Directive 5500-7-R, Joint Ethics Regulation, dated 23 March 2006.
Defined as specified experiences that prepared the applicant to successfully perform the Judge Advocate duties and responsibilities, with the required competency level, as defined by the applicable position description.
Each applicant must have the education and validated understanding of the basic principles and concepts of the occupational series and grade for dual status technician appointment to the GS-0905 Attorney-Adviser program positions.
At least 24 months work experiences as a professional Attorney Advisor.
Knowledgeable of the Army and Air National Guard mission requirements.

Responsibilities

Serve as the full-time professional legal adviser and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, and state/territory unique public defense or safety structures or wing commander.
Serve as the full-time professional legal advisor and support to Sexual Assault Response Coordinator and State Equal Employment Opportunity advisors, and subordinate commanders to support the state prevention efforts relating to sexual assault, sexual harassment, and domestic abuse.
Serve as a professional legal adviser to the United States Property and Fiscal Officer (USPFO), state/territory National Guard senior leadership, state/territory National Guard directorates, and subordinate National Guard commanded units or state/territory level divisions.
Provide legal interpretation and guidance to managers and senior leaders on Title 32 § 709, United States Code, National Guard Program.
Recognize and identify complex constitutional, state-federal, and military-civilian jurisdictional issues frequently associated with the organization and administration of the Title 32 National Guard and articulate them in the appropriate forum or context.
Advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse.
Provide legal interpretation and guidance to managers and senior leaders on 10 United States Code, and the state equivalent to the federal Uniform Code of Military Justice.
Conduct legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts.
Address legal questions referred by administrative officials of the employing agency, such as questions concerning the interpretation and application of statutes, rules, and regulations as they pertain to contracts, claims, or other legal instruments involving private business, state, local, national, or foreign governments.
Address questions regarding the effects of provisions of proposed legislation or proposed changes in agency policies or regulations.
Research and provide legal advice in functional areas of Administrative, Labor, Medical and Physical Disability, and Ethics Law.
Provide legal assistance in accordance with prescribed instructions and within legal guidelines.
Plan, coordinate, and formulate litigation strategies.
Address complex and difficult legal questions and factual issues requiring extensive research, analysis and evaluation of available precedents.
Deal with issues in the functional areas and demonstrated abilities to quickly identify both the legal and judgmental issues.
Determine the facts and recommend effective solutions with minimal guidance or supervision.
Develop and provide solutions to conflicting or contradictory DoD regulations, directives, and policies, and other NGB or state 881 legal guidance.
Address and resolve complex and difficult legal case problems, legal questions, or issues involved in the drafting of interpretation or application of legislation, regulations, contracts, decisions, or opinions requiring a solution.
Prepare memoranda of reports that outlined and analyzed the factual and legal issues.
Prepare legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency.
Act as a legal litigator and prepare litigation reports, briefs, pleadings, and other papers associated with civil litigations.
Address Federal Labor-Management relations and participate as a collective bargaining member of the management negotiating team.
Act as the subject-matter expert to address complex and constantly evolving area of Medical and Physical Disability and Domestics Operations Law; conducted legal research, investigation and negotiation, and provided legal advice, opinions, recommendations, and legal memoranda.
Review programs that required analysis of interrelated issues of effectiveness, efficiency, or productivity; and, developed recommendations to resolve issues and problems.
Develop recommendations for overall detailed plans, goals, and objectives for implementation and evaluation of the legal program.
Address issues, problems or concepts and skilled in observations and analysis projections.
Address difficult and sensitive issues based on variations in the nature of the processes evaluated, the diverse missions of the units assigned, and resource limitations.
Compile, reconcile, and correlate data from various sources, separate service programs, and integral record systems.
Research, cross-check information, and interpret data to obtain accurate and relevant information.
Collect information, document data to substantiate and validate findings, facts, or violations of government policies, procedures, and instructions.
