About The Position

The Assistant General Counsel is responsible for performing a full range of legal services in support of Alliance as a member of the Alliance Office of Legal and Public Affairs. The work of the Assistant General Counsel will serve to mitigate legal risk to the organization through practice in a variety of legal areas pertinent to Alliance’s mission and to do so with a measured approach to utilization of outside counsel. This position is full-time remote. Selected candidate must reside in North Carolina and be willing to travel to court appearances in the Eastern part of the state as needed. Additionally, job duties may require selected candidate to be onsite at Alliance’s offices, judicial forums, and other community locations as needed.

Requirements

  • Juris Doctorate from an ABA-accredited law school and licensed to practice law in NC.
  • At least 5 years of applicable legal experience.
  • Legal experience representing state agencies or local governments.
  • Knowledge and experience with State and Federal laws, rules and regulations governing Medicaid, Healthcare, Managed Care operations and/or publicly funded healthcare services.
  • Knowledge of case, statutory, regulatory, and common law
  • Knowledge of judicial and quasi-judicial procedures regarding the rules of evidence
  • Knowledge of the rules of evidence
  • Ability to perform legal research in accordance with initial guidance as to methods of approach, source materials available, and policy and precedent of the office
  • Ability to understand and interpret constitutional provisions, statutes, administrative regulations, and precedents
  • Ability to analyze facts, evidence, and legal instruments
  • Ability to express conclusions and arguments clearly and logically in oral and written form
  • Ability to maintain effective working relationships

Nice To Haves

  • Experience in judicial settings and with judicial stakeholders in and around Johnston, Harnett, and Cumberland counties.
  • Medicaid law experience
  • Experience representing governmental entities.
  • Clinical or healthcare law experience

Responsibilities

  • Provide legal support to Alliance in all contracts necessary to Alliance functions including drafting, negotiating and advising on contracts such as Medicaid and State contracts, provider contracts, delegated services agreements, administrative contracts and others. Primary emphasis will be on all aspects of contract compliance with the North Carolina Medicaid 1115 and 1915 b/c waiver.
  • Mitigation of legal risk to the organization by providing sound and competent day to day legal advice under the supervision of the Deputy General Counsel in a variety of legal areas pertinent to Alliance’s mission and to do so with a measured approach to utilization of outside counsel. Establish stable working relationships with assigned Alliance departments to facilitate access to legal advice, review and advise on needed changes to agency and departmental practices, create training resources as needed, all with the objective to mitigate legal risk to the organization.
  • Perform legal research and analysis, gather and analyze information; write legal memos and papers; draft responses; review investigative reports, processes and related documentation as needed and may be required to make presentations and trainings to employee groups, provider and/or member groups and other external stakeholders such as advocacy and judicial organizations.
  • Represent Alliance’s legal interests by participating in collaborations with external stakeholders such as judicial and healthcare bodies and supporting consumer relations.
  • Represent and defend Alliance in all stages of legal challenges including quasi-judicial settings such as the Office of Administrative Hearings, EEOC and courts of competent jurisdiction, such as State and Federal courts of both original and appellate jurisdiction.
  • Review and determine the merits of a case; develop a case strategy, perform research to prepare for litigation, and conduct civil and administrative litigation.
  • Communicate with others outside of the organization, exercising participative management and negotiation skills that support agency strategy and organizational goals.
