About The Position

The Office of the Attorney General & Department of Law is seeking an Assistant Attorney General for the Worker Protection Unit (WPU). This role involves enforcing Virginia labor laws, including the Virginia Minimum Wage Act, worker misclassification, paid sick leave, and salary transparency statutes. The position requires close collaboration with investigative staff, conducting litigation in state circuit courts, and advising legislative partners. The ideal candidate will have significant litigation experience, particularly in labor law enforcement, and possess strong leadership, interpersonal, and communication skills. Admission to the Virginia State Bar is required.

Requirements

• A minimum of three (3) years of relevant litigation experience with a background in enforcing labor laws.
• Excellent leadership, interpersonal, and communication skills.
• Must be admitted, or eligible for admission on motion, to the Virginia State Bar.

Responsibilities

• Enforcing Virginia labor law as part of the Worker Protection Unit (WPU).
• Receiving referrals from state agencies regarding violations of the Virginia Minimum Wage Act and the misclassification of Virginia workers.
• Enforcing statutes that require the provision of paid sick leave and salary transparency.
• Working closely with investigative staff in WPU.
• Conducting litigation brought by WPU in state circuit courts.
• Preparing and presenting complex civil cases before state circuit courts.
• Planning, directing, and controlling litigation activities, involving subject matter jurisdiction, adequacy and admissibility of evidence, proper application of judicial precedent, and the rules of civil procedure.
• Working closely with state agency partners and other statewide stakeholders.
• Assisting in advising legislative partners during the legislative session.
