About The Position

This attorney provides a full range of legal services to the Divisions of Health Benefits, Social Services and Aging and Adult Services of the Department of Health and Human Services (“DHHS”). This position services a full range of client needs, including litigation in federal and state courts, litigation in the Office of Administrative Hearings and handling of appeals involving primarily Medicaid and all programs of public assistance issues in federal and state courts. Additionally, this position provides legal advice directly to the client and assists with many different aspects of the Medicaid program. Some travel, including some occasional overnight stays are required.

Requirements

  • Licensed to practice law by the North Carolina State Bar
  • Three years of progressively responsible professional legal experience.

Responsibilities

  • Independently handles complex litigation with minimal supervision before the Office of Administrative Hearings and in State and federal courts involving Medicaid and other public assistance programs.
  • Litigation typically requires analysis of legal issues and defenses; legal research; development of case strategy; drafting pleadings, legal memoranda and briefs; conducting discovery; engaging in pre- and post-trial motions practice; identifying, preparing and examining witnesses, including expert witnesses; preparing evidence; conducting courtroom litigation; engaging in settlement negotiations; perfecting appeals; preparing appellate briefs; and presenting oral arguments.
  • Provides general counsel and advice to the client agencies on a variety of public assistance issues.
  • Drafting or revising administrative rules, legislation and policies.
  • Representing the client agency before the N.C. Rules Review Commission.
  • Drafting and reviewing contracts and MOUs (memorandum of understanding).
  • Responding to subpoenas, public record requests and citizen inquiries.
  • Drafting advisory letters.
  • Advising on issues such as recoupment of money owed to public assistance programs, service provider issues, interpretation and application of various State and federal statutes, rules and regulations, confidentiality of records and information, and preventive measures to avoid future litigation.
