About The Position

This position represents the State of Florida in all criminal appeals filed with the District Court of Appeal and the Florida Supreme Court. It also involves representing the appropriate state official in habeas corpus proceedings filed by state prisoners in federal courts and handling extraordinary litigation in both state and federal courts. Additional duties may include civil litigation, special projects, post-conviction litigation, and opinions as assigned by the Bureau Chief.

Requirements

• Admission to the Florida Bar.
• Two years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings.
• Required legal experience must be from the practice of law in a state or territory of the United States.
• Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment.

Responsibilities

• Supervise the timely filing of necessary pleadings and documents comprising the record on appeal.
• Review assignments of error.
• Conduct research necessary to prepare and file briefs setting forth the contentions and positions of the State of Florida.
• Perform oral arguments and all other responsibilities attending the prosecution of a criminal appeal.
• Respond to claims of prisoners asserting federal constitutional rights violations in habeas corpus proceedings.
• Review all state proceedings resulting in the conviction questioned in habeas corpus cases.
• Supervise and prepare necessary pleadings and responses for habeas corpus proceedings, including exhibits.
• Handle all hearings and prepare post-trial proceedings for habeas corpus cases.
• Handle appeals from habeas corpus proceedings to the United States Court of Appeals for the Eleventh Circuit and the United States Supreme Court.
• Handle extraordinary litigation in state and federal courts.
• Handle any other special assignments or duties assigned by the Bureau Chief, including civil litigation, special projects, post-conviction litigation, and opinions.
