About The Position

The New York City Police Department's License Division administers the laws and rules pertaining to the Police Commissioner’s power to grant handgun licenses, rifle and shotgun permits, dealer’s licenses, gunsmith licenses, small arms range designations, and Special Patrolman designations. The Division accepts, processes, investigates, and grants or denies applications for these licenses and designations within the applicable laws, rules and Department policies. It is also responsible for cancelling, monitoring and suspending or revoking these licenses and designations, in order to protect and promote public safety. The division is additionally responsible for adapting to rapidly changing State and local rules and law following the Supreme Court of the United States recent decision in New York State Rifle & Pistol Association, Inc. v. Bruen. The New York City Police Department’s License Division administers the laws and rules pertaining to the Police Commissioner’s power to grant handgun licenses, rifle and shotgun permits, dealer’s licenses, gunsmith licenses, small arms range designations, and Special Patrolman designation. Reporting directly to the Director of the License Division, the agency attorney will:

Requirements

  • Admission to the New York State Bar
  • One year of satisfactory United States legal experience subsequent to admission to any state bar; or Six months of satisfactory service as an Agency Attorney Interne (30086)
  • Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
  • To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
  • To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Responsibilities

  • Schedule and conduct administrative hearings pertaining to the suspension and revocation of firearms licenses and Special Patrolman designations
  • Write and timely submit for review recommendations following administrative hearings regarding the suspension and revocation of firearms licenses and Special Patrolman designations
  • Liase and assist the NYC Law Department with litigation stemming from suspension and revocation of firearm licenses and permits, including reviewing draft court filings
  • Serve as the legal subject matter expert on licensing issues both internally with the Department and externally with other agencies as directed
  • Where appropriate, apply for extreme risk protection orders (ERPOs) in conformance with the NYS Civil Practice Law and Rules and make any court appearances to secure such orders. Consult with the relevant prosecutor’s office on these matters when necessary
  • Where appropriate, assist with the preparation of documents utilized by the License Division, or distributed to members of the public
