Requirements

  • Juris Doctor
  • Requires membership in the State Bar as an Attorney qualified to practice law in Wyoming.

Nice To Haves

  • Knowledge of unclaimed property law and broad legal experience in contracts, business organizations, commercial paper, secured transactions (including UCC), domestic relations, bankruptcies, tax, constitutional law, insurance, oil and gas law, wills, trusts and estates, property law and litigation.
  • Ability to work with diverse sources of unclaimed property and adapt to emerging areas such as cryptocurrencies and digital assets.

Responsibilities

  • Advise the Unclaimed Property Division on complex legal issues affecting the ownership, disposition and return of unclaimed property, including matters involving bankruptcies, business entities, insurance contracts, domestic relations, oil and gas interests, retirement benefits, probate proceedings, trusts, estates and other property rights.
  • Conduct legal analysis and provide recommendations to support claim determinations and ensure compliance with applicable state and federal laws.
  • Act as the primary point of contact for public records and external communications requests on behalf of the office.
  • Evaluate incoming requests, determine applicable confidentiality and disclosure provisions, coordinate and prepare accurate, timely responses consistent with state statutes, agency procedures and legal requirements.
  • Review and advise on holder examination and audit commencement letters and agreements with external examiners to ensure compliance with applicable laws, policies and program requirements.
  • Draft and amend unclaimed property laws, rules and agency policies to ensure clarity, consistency and compliance with applicable legal requirements.
  • Monitor unclaimed property litigation and emerging issues nationwide, including matters impacting the office, to inform legal analysis and agency guidance.
  • Attend unclaimed property meetings and stakeholder engagements, including NAST and NAUPA forums, to support coordination and stay informed on national developments.
  • Assist with additional Unclaimed Property projects, including safe deposit box property sales and disposal processes, applications, forms and related program needs.
  • Support fraud prevention efforts involving more than $350 million in unclaimed property in Wyoming and assets located in over 139 foreign countries, including OFAC-sanctioned jurisdictions.
  • Assist in coordinating with federal law enforcement on asset seizures and related enforcement actions.
  • Other duties as assigned.
